PDP sues Speaker, 20 Kwara lawmakers for defecting to APC

The Peoples Democratic Party, PDP, has sued the Speaker, Razak Atunwa, and 20 other members of the Kwara State House of Assembly to court over their defection to the All Progressives Congress.

In the suit filed at the Federal High Court, Ilorin, on Friday, the state chapter of the PDP and a suspended member of the assembly, Iliasu Ibrahim, prayed the court to declare the seats of the 21 lawmakers vacant.

The plaintiffs joined the Independent National Electoral Commission, INEC, as a defendant in the suit Number FHC/IL/C5/4/2014. Continue...



The originating summons was supported by a 24-paragraph affidavit deposed to by Mr. Ibrahim.
The plaintiffs urged the court to evoke provisions of Sections 109 sub-section 1 (g), 153 (f) and 15 (a) of Part 1 of the Third Schedule of the 1999 Constitution.

They averred that the defendants had vacated their seats in the assembly.
According to the plaintiffs, the lawmakers ought to vacate their seats in the House since they defected from the PDP on which platform they secured the seats.

The PDP and Mr. Ibrahim are also asking the court to order the INEC to conduct fresh elections to fill the seats allegedly vacated by the legislators.

The plaintiffs claimed that this would be in line with the provisions of Sections 153 (f) and 15 (a) of Part 1 of the Third Schedule of the 1999 Constitution.

They urged the court to restrain the defected lawmakers from parading themselves as members of the House or performing duties relating to their respective offices.

The plaintiffs also prayed the court to order the defected legislators to refund and return to the state’s treasury, any money they collected as from January 22, when they defected to APC.
No date has been fixed for hearing on the case.

Before the lawmakers defected to the APC, the state governor, Abdulfatah Ahmed, had in November 2013, decamped to the APC.

I find it laughable how PDP couldn't bear what they hitherto celebrated.
Could recall how PDP benefitted from politicians defecting from their parties to PDP and such occassions were celebrated with elaborate ceremony.

U can only claim they won election under ur flag and that their offices are no vacant,then INEC will conduct elections for the vacant offices.

All this while that people from other parties were defecting to PDP,why dint those ones sue the people that defected?

Its funny how the nigerian political cocoon is ripped up wiv pitiable and pathetic people. The court is a record house, did they go to dig up records on such cases as happened in the past. What was the resultant judgement? I think there is another agenda behind the suit because we know they will never get the ruling in their favour unless a new bill is passed regarding such matters. So I suggest they lobby up such a bill even at the state level before going to equity.

Bonario you are so smart sometimes. I don't know what the law is concerning carpet crossing, but virtually all the ANPP lawmakers defected to PDP with pomp and peagentry. Didn't hear about any lawsuits then.

What PDp r doing is utter nonsense! & is nt done anywhere in d world. The law makers hv d right to defect, the constitution is backing it. The constitution stipulate dat any member can defect to another party despite winning election on d platform of a party on d ground of division in d party. Obviously there is division in PDp & everybody is aware of it, PDp are just bunch of school boys for all I cares! Considering d fact dat election is just at d corner they should use d energy on d existing members & try to sanitise d party so dat d defected ones may come back, they r there fooling themselves. @SHoK

Why is pdp now running to court to stop defection?hav dey forgotten when senators Obanikoro frm Lagos state decamped frm AD to PDP?Theodore Orji,the present governor of Abia state from PPA to PDP.Defection had been part of our politicking strategising for 2015 elections.PDP already know its a lost battle for them to stop defections that's why even at the national level they are luring opposition politicians to defect as well with promises as in the case of the two house of rep members from nasarawa state that defected from APC to PDP....

Bonario learn to keep quiet if you do not understand something... The law is very clear; you cannot abandon the party through which you were elected unless that party merges with another party or if there are factions in the party.

Secondly, the fact that the other parties failed to act when their members defected does not mean that the PDP should follow suit. For your information, this is not the first time the courts will be intervening in matters like this; a labour party house of reps member who defected to the ACN in Ondo state had his seat declared vacant by the court. http://www.punchng.com/news/court-sacks-ondo-rep-for-dumping-lp/
