Appeal Court upholds Ibinabo Fiberesima's five year jail term

Let me start from the beginning so it's easy to understand. In 2005, actress and mother of three Ibinabo Fiberesima was involved in a vehicle accident on Lekki-Epe Expressway in Lagos that cost a man his life. She vied off her lane and hit the car of a doctor, Giwa Suraj, who was a staff of Lagos state hospital. Ibinabo was arrested for dangerous and reckless driving and charged to court.

The case went to court and the Igbosere magistrate court sentenced her to five years in prison with an option of N100k fine. Ibinabo apologized to the man's family, paid the N100k fine and thought the case was over but the Lagos state government objected to the fine and took the case to a high court...

The High Court then said that the Magistrate court was reckless when they gave Ibinabo an option of fine for such an offence. The High court judge tossed out the N100k option and sentenced Ibinabo to five years in prison, saying that such an offence - reckless and dangerous driving which causes another person's death is liable to 7 years in prison. Ibinabo's N100k was subsequently given back to her.


So she and her lawyers took the case to court of Appeal, asking the court of appeal, Lagos Division, to set aside the prison sentence and restore the sentence she received from the magistrate court (N100k) but unfortunately, at the judgement that took place today March 11th, the court upheld the high court ruling and dismissed Ibinabo's appeal, saying it lacked merit.

Ibinabo was in court today and reportedly wept when judgment was passed. She and her lawyers are now heading to the Supreme court to appeal. If they fail at the Supreme Court, the AGN president will be spending the next few years in prison.

Nigerians are incredible. There is no sentiment in law. This is not about forgiveness, it is a "crime" not a personal wrong to take a human life through reckless driving under the influence of alcohol. Inasmuch as we have enough humanity to feel compassion for her, let us not insult the family by asking them to forgive because "it wasn't intentional and it was a long time ago". At this point, she can only ask for a reduction in her sentence, not forgiveness. You cannot monetize a human life. 100k as a penalty was the worst insult the family of a medical doctor could ever receive for the loss of their loved one and breadwinner. She needs to serve time, not pay a fine that can't even buy you the last model of a Samsung phone or iPhone.

The law is not here to feel sorry for you. If you are looking for sympathy and cuddles, get a dog.

Exactly my dear, the judiciary in this country is messed up assuming they gave her a fine of 5m or more and she followed up the family well this issue will not come up again, Kai just after getting married anyway sha everybody get their own wahala sorry for her sha

Listen,nobody wishes to lose thier dad.but jailing her for 100 yrs won't bring him back.she didn't kill him intentionally,she has kids tooo.ppl make mistakes.in this life be very careful because when karma comes at u,u will be speechless.i can. I feel for her children, n the deceased family. I know she was wrong but at the same time it's an accident. I don't think she did that intentionally .but what if this happened on the express way n the killer was not caught?. If she truly pleaded with the deceased family with her whole heart I think dey should forgive her. I know it's not an easy thing losing someone especially an important person. But spending such years wouldn't still bring back the corpse life. But if she wasn't pleading with her whole heart, not remorseful, may be she's feeling with her money she can get away with it then they can go to any length to deal with her. Just my opinion tho

Man is not above mistake and a mistake was made and these past ten years has definitely been difficult for her. Relieving the moments over and over again. Emotionally she has suffered enough.sp thos sentence is not justice its criminal.

This is the only way she can be free. She can promise to take care of two of the man's children till university level or pay the school fees of the man's siblings etc. Also, she should pray very very hard to God before she approaches the dead man's family. Get very close to God at this point. My spiritual honest advise.

But she didnt just go out to deliberately kill the man na. It was a mistake. Even the judge that judged the case can mistakenly hit somebody with his car too. Nobody is above error. If i am to judge the case, i would have said she should take care of the man's children or siblings and pay their school fees until university level because her going to jail will not bring the man back to life. I saw this lady appear on Jara recently. She was laughing with Helen Paul and Uti on Jara. I never knew she had this kind of hot case on her head. She should have kept a low profile so that the family will not remember her and be angry. Or she should have helped members of the man's family financially or even sponsored one member of the dead man's family abroad to study or just do something unique that will calm the famiy down a bit.

Infact, the magistrate who gave 100k for a life should be sacked with immediate effect, if it had been his or her daughter that was killed, na 100k e for give abi? Wicked being! Maybe just maybe if d magistrate had given her say like 2million, d case would have been buried n gone. The case is against the state but the family must have pressurised for an appeal after the unfair judgement, 100k!!! Like seriously?

@Anonymous 7:58AM in 2005 which is 10 years ago, 100k could buy a lot including the latest samsung and iphone. Although i would have prferred if the judge had said she should take care of the dead man's children's school fees until university level. That would have been a better judgement not 100k even though 100k could do a lot then.

Since Ibinabo removed food from the mouths of the family of the dead man, she should take care of the man's children and wife until the wife marries again and until the children finish school. This would have been my judgement if i was the judge. The bitter truth is that jail term will not put food on the table of the family members. Also, jail term will not bring the man back to life.

I am a lawyer. This case was not judged properly. In any cases that a crime was commited unintentionally, there must be an option of a fine or some other form. If it can be proved the it was not done deliberately, then she should have an option although i do not agree with the 100k. It was way too small even if 100k was big money in 2005. They should have told her to take care of the children or dependants of the deseased until they are able to stand on their own. Supreme court should give an option or she goes to jail. She should choose one. A reasonable option must be there

I have a brother that had an accident that killed a 4 year old boy. Although the boy didnt die immediately. The boy later died in hospital after some days. My family took care of all the hospital bills and burial. We even paid school fees for the deseased only brother and later sponsored him abroad because he said that was what he wanted. He even stayed with our relation abroad but he is now on his own doing well. He now has his papers to live abroad. We also visited the family from time to time and even helped them pay rent and some bills sometimes. This was the least we could do as we could not bring back the life of the dead. The family was a nice christian family and they understood that if God didnt want it to happen, God would have saved the boy's life. They told us that God gives and God takes. Such a humble family. Pray you dont accidentally kill someone that has a wicked heartless family. Lastma, road safety and the police were at the scene when the accident happened but they never charged the case to court. Why is this one different? Is it because there is a celebrity involved?
