Ban on Hijab in Lagos: Court fixes September 26 for judgment

Months after the use of Hijab by female students was banned in all public primary and secondary schools in Lagos State, a Lagos High Court in Ikeja has fixed September 26 to deliver judgment in a suit filed by the Muslim Student Association of Nigeria against the Lagos State Government.

Counsel to the students, Mr Gani Adetola-Kaseem in his arguments in court yesterday Friday July 4th maintained that the essence of wearing Hijab by Muslim females is to prevent them from tempting people of the opposite sex or being tempted by them and also to protect their chastity. Continue...



The lawyer also insisted that it is mandatory for all Muslims who have attained puberty to participate fully in the practice of Islam, including Islamic dressing mode, worship and fasting.

He submitted that from the Islamic point of view, womanhood is determined not by biological age or marriage but by the time a person has attained the age of puberty. This age he says varies between individual. Some females attain puberty as early as the age of nine years while others attain puberty at age 13 or more.

The lawyer therefore urged the court to grant the application because the position of the Lagos State Government violates the religious rights of the applicants and it is the duty of the court to protect them.

In his response, the counsel to the State Government, Mr Lawal Pedro, argued that the wearing of uniforms in public primary and secondary schools is for identification of students from different schools in Lagos and also to encourage a sense of unity, discipline, organisation and orderliness amongst the schools.

He also submitted that the clamour and demand for the compulsory use of Hijab on top of the school uniform by Muslim girl students in Lagos is a recent development.

Two Muslim students, of Atunrashe Junior High School, Surulere, Lagos State, Miss Asiyat Abdulkareem and Miss Maryam Oyeniyi, had filed the suit through their fathers – Alhaji Owolabi Abdulkareem and Mr. Suleiman Oyeniyi.

In the suit, they claimed that the restriction of the use of the Hijab, violates their fundamental human rights.

They also argued that banning female students from using Hijab on or outside the premises of any educational institution in Lagos State “is wrongful and unconstitutional”.

The defendants in the suit are the Lagos State Attorney-General and Commissioner for Justice, Mr. Ade Ipaye; the Commissioner for Education, Mrs. Olayinka Oladunjoye; and the Commissioner for Home Affairs and Culture, Mr. Oyinlomo Danmole.

Islam has it's laws and tenets just the same way different organizations have their governing rules and in order to forestall conflicts boundaries should be clearly identified. Schools have their respective uniforms for identification and differentiation between them and allowing students to wear different colors of hijab to school SHOULD NOT be condoned. Nigeria is not an Islamic state and fanatics should cease to impose their religion on extant laws.If they feel strongly about having their kids wear hijab to schools that harbor kids from different convictions, they can as well withdraw them and employ private home tutors and save the world their troubles.

It is not even a requirement for Muslim women to wear a veil or Hajib in Islam. A veil is not a Burka or Hajib and neither of those two coverings are mentioned in the Koran or Hadiths as obligatory. The only reason the veil/hijab is worn by some women is because Mohammad made his wives wear it - out of jealousy!!! He hated seeing his wives flirt with his companions so he made rules up for them and only them to wear it. But Muslims are also told that Mohammad was the most pious man and should be emulated as much as possible - so Muslim men force their wives to wear a Burka/veil/hijab in public just as Mohammed did with his wives. What this boils down to is this is NOT a religious garment but one of oppression. More needs to be done to stop Muslim women from wearing these garments as it is now used mainly by the BH group to deceive security agents when they wear the veil/hijab to cover up the bomb they are carrying.

I don't see what is wrong in them wearing hijab to school. Even outside the country wearing hijab to public schools is not a problem. If it was for private school then we can say the rule make sense but for schools owned by the government the rule makes no sense. Nigerian government should try to face the real problem we have with the country and not what people want to do in terms of the way they dress based on their religion. It is actually sad that real problems are not faced, they are whining over things that makes no sense. I feel sad for Nigeria.

I ve not really commented on LIB b4, but am compelled to do so now. Nigeria, the last time I checked is not a muslim state and as such one religion cannot impose their rules on the state. I was at the a Call to Bar in Abuja sometime last year and I saw both muslims and christians and even pagans dress in their nice suits and shoes, with their wigs on. Maybe muslim could have insisted that they enter the call to bar centre with their Hijab? No, they didn't, cos that's the rule nd its no respecta of anybody. The law is for Lagos state and not for Christians or Muslim, how unconstitutional is it? The right to freedom of religion is guaranteed so is the right of the state to make Laws for the betterment of their state, and the management of state own schools is for the state alone. I wonder how the court will enforce any order in contravention to the sanction made by the Lagos state govt? If the govt insists on the ban, what happens?

I guess you did not read my first post on this matter. Read it again and note what I wrote. It is not obligatory for Muslims Women to wear garments that gives them out as masquerades. Mohammed mandated his women to wear it out of jealousy, He does not want another man to look at his women therefore he made rules for them. One of those rules is the punishment of masqueraded garments to cover up themselves hair to toe. Of cause his followers or today's Muslim men copied same and ask their women to wear same not minding the heat and degradation it brings to the women folk and worst of all suicide bombers today hides in same cloths to throw bombs thereby deceiving the Military authorities. Or haven't you heard of people disguised as Hijab wearing Muslims that bombed military posts and other places recently?

creating problem where there is none. please dont start what you cannot finish. dont bring religious problem to the state please. what is the problem with the hijab? instead come up with a uniform hijab approved by the state since muslim students want hijab.after all is a decent way of islamic dressing as against unnecessary display of nudity.
