Top Nigerian artistes call BON/IBAN bluff

Below is a press release from Efe Omorogbe on the ban of Nigerian artistes by the Broadcasting Organization of Nigeria (BON) and Independent Broadcasters Association (IBAN)
Less than 48 hours after the Independent Broadcasters Association (IBAN) and Broadcasting Organization of Nigeria (BON) issued a statement banning the broadcast of the music of nearly all of Nigeria’s topmost musicians on the radio and TV stations run by affiliate stations, a group of star musicians and top players in the music industry have fired back. Continue...

The group comprising the likes of 2 Face Idibia, 9ice, MI, Azeezat, Ill Bliss, WunmiObe, Dizzy K. Falola and representatives of Burna Boy, Sound Sultan, DammyKrane, Sir Victor Uwaifo, Ice Prince, Sunny Neji, etc met at Whitehouse Hotel, GRA, Ikeja on  Wednesday, December 4. One after the other, the music industry stars expressed outrage by the decision of BON and IBAN and their attempt to manipulate the music industry so that they can run away from their responsibility of paying copyright royalties for music broadcast by them.

They rose from the meeting with the following resolutions:

1.   That all authors, composers, songwriters, artistes, performers, publishers, record label executives, owners of sound recordings, publicists, managers, etc should ignore the IBAN email and no right owner should send any message to the email provided by IBAN.

2.   That no self-respecting right owner of the Nigerian music industry should sell his/her birth right by sending an email to BON or IBAN to request that they play his/her music.

3.   That the music industry will consider the stations that  comply with their copyright obligations and advice all right owners to move their works to the stations and encourage their fans and followers to support such stations.

4.   That a delegation of the music industry is to meet with appropriate political office holders within the shortest possible time on this matter.

5.   That all IBAN/BON stations not licensed for the use of music should take note that with immediate effect they should cease to broadcast music whether local or foreign on their stations - These stations must also suspend the use of music whether wholly or in part by way of sampling, interpolation, remixing or outright jacking pending the resolution of this matter.

6.   That this movement is a historic fight for the recognition of the fundamental human rights of all creative people in the Federal Republic of Nigeria and no creative person should sell out or allow himself/herself to be made a saboteur in this historic battle.

7.   That all important stakeholders in the music industry should make themselves available for a full briefing and Q/A session at a follow up meeting to be held on Tuesday, December 10, 2013 at Rumors Night Club, 15a, Oduduwa Way, GRA, Ikeja, Lagos by 10.00am.

The long list of COSON members said by BON and IBAN to have been banned with immediate effect include TuFaceIdibia, D’ Banj, Inyanya, Olamide, Dr Sid, Sammie Okposo, Banky W, Wiz Kid, Olu Maintain, 9ice, Sunny Neji, Flavour, Chidinma, Rugged Man, Keffee, Midnite Crew, Eldee De Don, M I, Azeezat, Jazzman Olofin, Ice Prince, Jesse Jagz, KC Presh, X Project, Asha, Konga, African China, Owen Gee, Dekunle Fuji, Lord of Ajasa, Zoolezoo, Ekwe Original Stereoman, Danfo Drivers, Rhymzo, DJ Jimmy Jatt, Kofi, Jedee, Muma Gee, AY. Why are the Stupid idiots fighing radio stations for? How many of them can boast of quality lyrics in their songs when that supposed to be their priority. Radio brought them all to the limelight and the glory they all sit to enjoy today. Now they think they've arrived to put on a fight for royalties, some of them mentioned in the list are lazy Mother Fs that needs to get a life and better job to do.

Anonymous said...

So its only radio they want to put up a fight with, how about thousands of freedownload outlets out there, the clubs and the djs???.radio is till the major platform which helps their career most,to this stage they are now...the system which was not well structured from on set, now they want to begin form RoboCop.yeye!!!

Anonymous said...

the real reasons are not being addressed here, most of the radio or tv stations are not saying they wont pay royalties, all they are asking for is a verifiable and agreed rate..Tony Okoroji has just been imposing figures on these stations which is not fair, afterall the networks have charges rates.

Anonymous said...

its high time these broadcast stations understood that the years that they have milked the muisc industry under the guise of helping them. the case is simple, pay music royalties for the greater good of our today's musician

Its funny how an artist like Eldee that the same industry helped to grow will send silly tweets but i dont blame him sha, when last did he make a hit song? if he read well, it is clear that IBAN and BON are also in the interest of these artists. They are only requesting for a more organized and uniformed way of collecting and distributing royalties, so we are sure its not just another looting process.

Emeka Okpara said...

This is the triumph of intellectual property rights in Nigeria. BON and IBAN should be glad about it. It may increase their operational cost initially, but it'll benefit the polity in the long run. We should grow to respect intellectual property. I hope photocopiers will get their own lashes of a similar whip soon.

The problem is not BON or IBAN but some NCC Civil Servants/COSON who want to claim Ownership of what they do not control. Monopoly is dead everywhere in the world. EQUAL Rights and Justice MUST prevail. There is more than meets the eye in this matter ooooO

Anonymous said...

P Square, have mentioned that they do not belong to COSON because they found out its a fraud on Nigerian musicians by Okoroji and Efe whom he employed and made Director of COSON plus the NCC officials and yet Tony Okoroji continuesto use the name

Anonymous said...

Let us not mix the issues plsssssss. BON/IBAN says they woukd not play the music of COSON members ONLY and not the entire Nigerian music. Meanwhile, let us not forget also that most works are Copyright works. So they can still play Banky's EBUTTE MEtta because it is a copyright of RIHANNA and not Bankys'

Anonymous said...

These musicians are not the only ones we have in Naija plsss but na dem get stage now. We have Paul Dairo, Iddris and alot of others who are not on the list which means music will still go on. Okoroji's time is certainly up. The industry is bigger than him and his servants

Anonymous said...

Lies are powerful, fearless and daring when the truth is absent. But the Truth at the end, ALWAYS arrive to clean up the mess. COSON knows thetruth has come and it is fighting hard to stay when it now obvious it was built on sand

I'm happy for Sunny Nneji and Onyeka Onwenu for walking out of a repressive administration of Tony Okoroji. Mumu Efe stay there your integrity will soon be throw to the dogs.

payment of N100m royalties to musicians Can any Musician Boost that they received 300k as royalty from Okoroji's fake 100 Million Naira royalty scam, apart from about 6 musicians whom him paid for reputation purpose only not because they deserve it Tony paid between 1m - 3m(Show man Show) to them ,Okoroji was paying Artiste's 30k,5k,7k ,16k as royalty.
Its been three years has any one or any musician see COSON yearly financial report? Is it not suppose to be made public? One COSON is a non profit organization, but Tony has converted to his personal empire and made it private

Efe has no investment in the music industry beyond been a manager to Tuface ,Juliana, an Album by Tony Okoroji. Released in 1976 finish.beyond the above they do not deserve to be where they are, ripping and stealing from the public.

These men at COSON are waiting to reap where they did not sow by dangling a carrot in front of the artistes. The artistes are hearing money and getting greedy. Pay royalty to Nigerian artiste? Are you stupid? Has the economy grown to that point? How many people have money for itunes in naija. See artiste deluding themselves, thinking they have the fame of Micheal Jackson. You better be careful else you will start paying heavily to have your songs played. The average naija artiste is doing better than their South African counterpart, rather than work on improving the structures that has brought them this far, they are going after the media that made them famous. Artistes should come for advise on how to maximize profit. -Newyorker

Mumu COSON Musicians no money for una this YEAR! simple because Okoroji has used your royalty income to settle his high profile Lawyers(suing could have been prevented,if only he learn to be diplomatic and control is temper),his high profile life style and his globe trotting moves.
So guys don't blame BON/IBAN for non royalty payment this year blame Okoroji.
Tony has collected money running into millions, let him give account so far minus BON/IBAN .
My Guys ask for accounts to date ,I beg make una no fold my hands O,
COSON is suppose to be a public company, how come there is information on salary structure of Staff, board of directors and Oga @ the top,the truth of the matter is, if you Guys should know the state of salary and other numerations UNA GO SCREAM BLUE MURDER!!
NO YEARLY FINANCIAL REPORT FOR THREE YEARS made public?, WETIN? NO info on their website or published any where.NO INFO HOW 100 Million royalty was shared,Musicians shine your eyes,CHIEF TONY OKOROJI AND EFE they are not your messiah.
COSON is an extension of NCC,they have personal financial gains in COSON.

How long would Okoroji continue to enslave Nigerian Musicians plssss. Haba! Guys wake up! Open and Shine your eyes na. The same Okoroji Under PMAN collected so much money and even wanted PMAN to be a collecting Society but when he did not succeed, he destroyed PMAN and went away with all the money to open spare parts shop on Opebi. When the shop closed he returned back to form another PMRS using the name of “Nigerian Musicians” again and collected Millions only to close it down so that he would not account for the money. He deceived us again and change the name to COSON and has collected Billions now he wants to vanish again leaving mumu Efe to see what he can do. We don wise pass dat levels I beg.

Okoroji and COSON collects money on behalf of people who do not belong to COSON and he will tell you that you MUST join COSON to get your money. Is that not fraud ? When you did not give him your rights to collect in the first place. EFCC should do something about this man called Okoroji please.

Anonymous said...

NCC officials who are behind this COSON people should be sacked immediately. They have destroyed this industry for so long and benefited so much from Okoroji’s Industry. God will not forgive you people.

Anonymous said...

Okoroji MUST account for all the monies he has chopped before they close down COSON office please because this is how he would do and now say he has resigned. Na magician style.

Anonymous said...

We are following all the issues and have discovered from available statistics that ONLY 5 - 10 percent of Nigerian Musicians belong to COSON. Another 5 – 10 percent belong to other Organisations outside Nigeria. 10 – 15 percent do not belong to any organization. 5 percent don’t even know anything about copyright yet. While the remaining 60 percent belong to MCSN which the NCC have refused to recognized because of their interest in running a collecting Society. So when COSON speaks it can not be speaking for ALL Nigerian Musicians. NCC cannot give what they do not have so COSON cannot act on behalf of 90% of the Industry. THIS IS A VIRIFIABLE FACT!

Anonymous said...

It is shocking to read that “Top Musicians” call BON/IBAN bluff. It seems to me that BON and IBAN have made them so popular and they have made so much money and now want to open their own TV and Radio stations (LoL). Tell me a top musician in Nigeria that has a very good and operating Music Studio? I think they want to gradually fade out and leave the stage for others. It is the chain of Life so they should just accept it and step aside please. Other will surely rule the stage.

Coson was pmrs which was put together by a bunch of thieves who created the music pirates while working for the foreign record labels like polygram, emi, and Sony. They stole so much that the foreigners had to run away and left their repertoire with an organization called Mcsn.. musical copyright society Nigeria. These thieves in order to continue their stealing rushed to form pmrs which failed and metamorphosed to Coson. Just a band of thieves. What a pity that the artistes, and authors and composers are so ignorant cos they don't want to study. If you notice that Jude of p square, don jazzy and his crew are not there. Most names on the list have no contracts with Coson but because they are thieves they collated all known names as members. Morons..!

Let the truth be told.

The central message of IBAN/BON’s decision is that the monopoly position being enjoyed by COSON is being abused and government should do something about it, otherwise they will look elsewhere for their music. The question any discerning mind should therefore ask is, why should there be a monopoly in an environment in which the government has liberalised every activity ranging from broadcasting to communication, banking to airline and even petroleum to electricity? For those defending COSON’s monopoly, the same arguments which justified monopoly in the newspaper, broadcasting and telecommunications industries during the military era are still being advanced to justify COSON’s monopoly in 2013 under civilian democracy! To the Nigerian musicians, the question they should ordinarily ask themselves is what is government’s interest in forcing COSON down their throats as the sole collecting society against the constitutional provisions guaranteeing their freedom of association? If government wanted a monopoly in that sector why not establish a government company or parastatals? Why making a monopoly out of a private company owned or formed by Tony Okoroji and a few of his friends? Most importantly, if COSON fails to deliver (like it has started to fail) on services, where does the average Nigerian musician turn to for quality or comparative services? This is the real issue on ground. Even God gave us the right ti decide btw good and Evil

Anonymous said...

Weeping may endure for a night but joy surely cometh in the morning – say the bible. BON/OIBAN please help use clear this Okoroji and NCC mess. So that we can enjoy our country like the people too in Abuja National Assembly who have abandoned us in this industry for they see Okoroji and his friends playing and trading with our life. TiME DON REACH!

An insider just told me now that the Cross River State government is also going to ban all COSON members works at the” Calabar Carnival”. Any musician who wants to be part of it should make sure their name is not on that list. Could this be the road to the fall of COSON or Okoroji’s + NCC’s Empire?

Anonymous said...

Cross River State Musicians whose names were used by Okoroji to get approval his cartel at NCC are set to sue COSON and Okoroji for 10 Billion Naira for misrepresentation and fraudulent use of the names and even having blacking them by suing the State government and wanting to stop their Carnival when they protested the inclusion of their names without their consent. A protest match is on the pipe line to the Government office on this matter next week. COSON has really damaged of Image

THIS IS SERIOUS! In the mean time I see lots of artistes pulling away (PORTING) from COSON in order to remain on aitr while this dispute goes on, I encourage upcoming artistes who will otherwise not get airplay to approach the stations now with their songs and state clearly that they are not registered with COSON – they will enjoy airplay now and also become popular If one person own no spoil anoda person own no go good abi ke...

Linda I beg kindly help contact COSON to provide documents to show that everyone in that list belongs to COSON. I can swear they would abuse you and you will never get such as it doesn’t exist. I am only sorry for those whose names have been used who cannot talk as if they are under one juju man who has used money or poverty to hold them. I am very sure now that the juju go fail and they will come out to speak. You just watch and see it unfold.

I agree with the you my brother, because why is Efe and the rest who have collected money and chop without giving us now begging that we should not write to BON/IBAN? There is something they are hiding from the public. Moment of Truth has come – we must talk I beg.

Hi Linda, God will continue to bless you as you are helping to expose these people. I want to tell the real truth here. Some of us joined COSON because we were told we had money to collect and the only way we can get it is if we join COSON, only to be given 12k after signing some documents and they gave us one bag with jotter inside and pamphlet and since then nothing else. Even they said they share N100 million we no see nothing. What a blackmail because we broke and needed money we sold our soul to Okoroji and NCC officials are part of this scam. Thank you BON and IBAN. I will write and withdraw my copyright from there. You can use my music please until we have another collecting society if those NCC greedy Civil Servants will approve another for us. COSON is for NCC we need another one for ourselves. I DON PORT oooO. This is why Competition and Liberalization is good. CASHMANIC

I heard the Federal High Court told COSON not to distribute the 100 Million when it was announced but they still went ahead because they wanted to cover up the questions that people will ask. Now I hear NBC wants to join hands with NCC to resolve this wahala but we know NCC is a major party in this whole saga because of their personal interest in COSON so who do they want to fool with all that meeting? NCC want to become a judge again in its own case. NIGERIA ooooooOOOO!!!!

Anonymous said...

Please whats the meaning of COSON is it a yoruba thing or ibo thing ?

Anonymous said...

What all this comments mean is that we are been managed by opportunist(Tony and Efe) without proper accounting,no proper investment in the music industry of their own?running monopoly racket.
Say no to monopoly

BON/IBAN please everything down until we get the accounts of How much every broadcaster have paid so far, how much all the hotels in Nigeria and restaurants and advert agencies etc have so far paid and how did COSON use and who did they distribute it to. No more sweeping things under the carpet. This is the ONLY way forward. NBC take note of this. Do not carry NCC with you otherwise your efforts will fail in this matter. Go and ask the AGF

I have read and heard many commentaries on both side of the divide, most of which were emotional and play on the psyche of our artistes “NIGERIAN MUSICIANS” who are usually at the receiving ends of such actions as represented by COSON and decision as made by BON/IBAN not to play Nigerian music “under COSON’s control”. Efe and his small new gang should not make us feel IBAN or BON is talking about everyone. They (coson) only form 5% of ALL Nigerian Musicians please.

Anonymous said...

That is how they punish us and made us come out at the National Theatre and went on “Hunger Strike” under the umbrella of The Nigerian Music Industry / Nigerian Musicians to fight piracy not knowing it was a ground and grand plan of Okoroji to get members for COSON. The very annoying part of it all was that while we went hungry everyday these people “at the TOP” went to hide themselves and were eating Mr. Biggs and Sweet Sensation Rice and Chicken ( this is not funny at all Linda) and until we caught them one day and that was how we ended the so called hunger strike. How long will they continue to use us? They only call us when they want to fight and when they settle they abandon us. We shall resist it this time. Efe and his small group can go ahead alone please Okoroji as the General while NCC officials are the area boys after collect our money and collecting salary from Government again – our tax money.

Isn't is so obvious that the Anonymous one from December 7(11.08) all the way to December 8 (4.23) is one and the same person and my question is why? Why is the person so desperate to hide the truth by publishing falsehood? My word to you is that since you know the truth and want to hide it from the public, the consequences of that wickedness will befall you. Keep at it but the truth will always prevail while you will wallow and groan in shame. As you encourage a lie and mislead people, the same the artistes have suffered through the abuse of their intellectual property, you will suffer a million folds, hunger will plague you all the days of your life. Your joy will be taken away, you this manipulator and liar.

All you fake anonymous commenters who have no part in COSON yet claiming to be members, if you have any issue with your society, why have you not gone to the office to lay your complaints. Why have you chosen a blog page to air your views on matters that concern your livelihood. If COSON collects money that belongs to you and someone is misappropriating it is a blog page the right place for you to get your case redressed. Stop decieving yourself and the public. You cannot do wrong and cover up by painting some people black.

Please pay musicians their royalties and stop this divide a rule tactics. BON/IBAN in the days of MCSN/PMRS said two societies created confusion for them and so they did not know who to pay to. Now you have COSON they come out to say the monopoly is now killing them they cannot pay. So at what point will it be convenient for them to pay. STOP DECEIVING THE PUBLIC PAY YOUR ROYALTIES. NO ARTISTE IS COMPLAINING THAT THEIR ROYALTIES ARE BEING DENIED THEM BY COSON. ANY SUCH PERSON CAN SHOW THEMSELVES NOW SO THAT THE WORLD WILL KNOW THEM. I KNOW COSON IS WORKING AS THEY SAY. LET THE MUSIC PAY!

CASHMANIC you are a liar and you are not in any COSON's register. If as you claimed you were broke then you sold your soul to Okoroji (12K). I am sorry for you because if the devil comes to you with 100k then you will be hell bound because you will rush to grab with everything you've got. But you know you are lying.

If you are true show your work. (Give a link where your music can be heard. Show your face)

If you have been paid to do this, repent because all liars will go to hell. Thank you

All the MCSN people parading themselves on this blog as anonymous, attacking two men instead of facing the issues. We see you oo. Meanwhile you MCSN 'Anonymous' read the story of ur lives here. The Federal High court has held that criminal charges filed against the Musical Society of Nigeria (MCSN) over the enforcement of Section 39 of the Copyright Act was in order.

Hahaha, there is no member of COSON called CASHMANIC... that is soooooo cheap. Try harder.

You say COSON members collect 12k, 15k etc and you don't know anyone who has received over 300k. That is so funny. Learn to write intelligently and that means DO YOUR RESEARCH and BE WELL EQUIPPED WITH YOUR FACTS. Nothing is hidden under the sun!

Its so disheartening how people peddle lies in the name of giving out facts. One incongruous Anonymous writer has continued to feed the public fat lies about his supposed fact on the true nature of COSON and PMRS. Does this bingo know that the name COSON was coined and agreed upon by major stakeholders in the music industry. Does he know that before the approval of COSON, all parties were asked to present their document to see if they truly meet the requirements to run CMO for music in Nigeria?
he claims NCC works for Okoroji; but COSON was approved by an MCSN lawyer and MCSN staunch advocate (can he deny this?).
Does he know that both MCSN and COSON officials agreed to the name COSON? That MCSN was given an opportunity to join forces with COSON to form a united body after the latter met the requirements.

That Mayo and Orits Williki were given juicy positions in the new body but rather wanted absolute control. All these are in black and white with witnesses alive to corroborate the matter.

That BON and IBAN are controlled by a cartel led by AIT's 'Low' Chief Raymond Dokpesi who has sworn to continue to impoverish Nigerian musician and the creative industry in the country.
That BON/IBAN have not even stated how much they want to pay despite having the breakdown of what they call arbitrary tarrif. That some members of IBAN/BON have been paying royalties before now but were advised to stop by the Almighty Dokpesi who has sworn to stifle and kill the creative community in the country by galvanising all radio stations not to pay.

What else is there to say than to advice Linda Ikeji whose blog has been used by many as reference point to block these liars who dont address issues but rather resort to name calling and abuse of different individuals. Nigeria music industry will not die, rather no matter the antiques of setbacks likes IBAN/BON/AIT and the illegal MCSN.

The first celebrated fraud Okoroji committe was when EFE was still in primary school. General Babangida gave PMAN 35 hectares of prime land and 10 million Naira (one Naira to one USD then), Okoroji miss maned the mone, no accounts and lost the land due to no development. General Babangida gave MUSON on Teemac's request a land near the Onikan Stadium (love gardens) and 10 million Naira. MUSON has become the most profitable non- profit organization in Nigeria. The Shell and Agip hall, the bank and the Restaurant are yielding MUSON more than 3 million Naira a day. They can spend the surplus on the MUSON Music school. Okoroji has been a know personality in the Entertainment Industry, known for his illegal dealings, it is time that EFCC investigates him and if COSON wants to survive, he has to be immediately fired.
