Top Nigerian artistes call BON/IBAN bluff

Below is a press release from Efe Omorogbe on the ban of Nigerian artistes by the Broadcasting Organization of Nigeria (BON) and Independent Broadcasters Association (IBAN)
Less than 48 hours after the Independent Broadcasters Association (IBAN) and Broadcasting Organization of Nigeria (BON) issued a statement banning the broadcast of the music of nearly all of Nigeria’s topmost musicians on the radio and TV stations run by affiliate stations, a group of star musicians and top players in the music industry have fired back. The group comprising the likes of 2 Face Idibia, 9ice, MI, Azeezat, Ill Bliss, WunmiObe, Dizzy K. Falola and representatives of Burna Boy, Sound Sultan, DammyKrane, Sir Victor Uwaifo, Ice Prince, Sunny Neji, etc met at Whitehouse Hotel, GRA, Ikeja on  Wednesday, December 4. One after the other, the music industry stars expressed outrage by the decision of BON and IBAN and their attempt to manipulate the music industry so that they can run away from their responsibility of paying copyright royalties for music broadcast by them.

They rose from the meeting with the following resolutions:

1.   That all authors, composers, songwriters, artistes, performers, publishers, record label executives, owners of sound recordings, publicists, managers, etc should ignore the IBAN email and no right owner should send any message to the email provided by IBAN.
 
2.   That no self-respecting right owner of the Nigerian music industry should sell his/her birth right by sending an email to BON or IBAN to request that they play his/her music.
 
3.   That the music industry will consider the stations that  comply with their copyright obligations and advice all right owners to move their works to the stations and encourage their fans and followers to support such stations.
 
4.   That a delegation of the music industry is to meet with appropriate political office holders within the shortest possible time on this matter.
 
5.   That all IBAN/BON stations not licensed for the use of music should take note that with immediate effect they should cease to broadcast music whether local or foreign on their stations - These stations must also suspend the use of music whether wholly or in part by way of sampling, interpolation, remixing or outright jacking pending the resolution of this matter.
 
6.   That this movement is a historic fight for the recognition of the fundamental human rights of all creative people in the Federal Republic of Nigeria and no creative person should sell out or allow himself/herself to be made a saboteur in this historic battle.
 
7.   That all important stakeholders in the music industry should make themselves available for a full briefing and Q/A session at a follow up meeting to be held on Tuesday, December 10, 2013 at Rumors Night Club, 15a, Oduduwa Way, GRA, Ikeja, Lagos by 10.00am.

Its funny how an artist like Eldee that the same industry helped to grow will send silly tweets but i dont blame him sha, when last did he make a hit song? if he read well, it is clear that IBAN and BON are also in the interest of these artists. They are only requesting for a more organized and uniformed way of collecting and distributing royalties, so we are sure its not just another looting process.

This is the triumph of intellectual property rights in Nigeria. BON and IBAN should be glad about it. It may increase their operational cost initially, but it'll benefit the polity in the long run. We should grow to respect intellectual property. I hope photocopiers will get their own lashes of a similar whip soon.

payment of N100m royalties to musicians Can any Musician Boost that they received 300k as royalty from Okoroji's fake 100 Million Naira royalty scam,apart from about 6 musicians whom him paid for reputation purpose only not because they deserve it Tony paid between 1m - 3m(Show man Show) to them ,Okoroji was paying Artiste's 30k,5k,7k ,16k as royalty.

These men at COSON are waiting to reap where they did not sow by dangling a carrot in front of the artistes. The artistes are hearing money and getting greedy. Pay royalty to Nigerian artiste? Are you stupid? Has the economy grown to that point? How many people have money for itunes in naija. See artiste deluding themselves, thinking they have the fame of Micheal Jackson. You better be careful else you will start paying heavily to have your songs played. The average naija artiste is doing better than their South African counterpart, rather than work on improving the structures that has brought them this far, they are going after the media that made them famous. The same Okoroji Under PMAN collected so much money and even wanted PMAN to be a collecting Society but when he did not succeed, he destroyed PMAN and went away with all the money to open spare parts shop on Opebi. When the shop closed he returned back to form another PMRS using the name of “Nigerian Musicians” again and collected Millions only to close it down so that he would not account for the money. We are following all the issues and have discovered from available statistics that ONLY 5 - 10 percent of Nigerian Musicians belong to COSON. Another 5 – 10 percent belong to other Organisations outside Nigeria. 10 – 15 percent do not belong to any organization. 5 percent don’t even know anything about copyright yet. While the remaining 60 percent belong to MCSN which the NCC have refused to recognized because of their interest in running a collecting Society. So when COSON speaks it can not be speaking for ALL Nigerian Musicians. NCC cannot give what they do not have so COSON cannot act on behalf of 90% of the Industry. THIS IS A VIRIFIABLE FACT!

Coson was pmrs which was put together by a bunch of thieves who created the music pirates while working for the foreign record labels like polygram, emi, and Sony. They stole so much that the foreigners had to run away and left their repertoire with an organization called Mcsn.. musical copyright society Nigeria. These thieves in order to continue their stealing rushed to form pmrs which failed and metamorphosed to Coson. Just a band of thieves. What a pity that the artistes,and authors and composers are so ignorant cos they don't want to study. If you notice that Jude of p square, don jazzy and his crew are not there. Most names on the list have no contracts with Coson but because they are thieves they collated all known names as members. Morons..!

The central message of IBAN/BON’s decision is that the monopoly position being enjoyed by COSON is being abused and government should do something about it, otherwise they will look elsewhere for their music. The question any discerning mind should therefore ask is, why should there be a monopoly in an environment in which the government has liberalised every activity ranging from broadcasting to communication, banking to airline and even petroleum to electricity? For those defending COSON’s monopoly, the same arguments which justified monopoly in the newspaper, broadcasting and telecommunications industries during the military era are still being advanced to justify COSON’s monopoly in 2013 under civilian democracy! To the Nigerian musicians, the question they should ordinarily ask themselves is what is government’s interest in forcing COSON down their throats as the sole collecting society against the constitutional provisions guaranteeing their freedom of association? If government wanted a monopoly in that sector why not establish a government company or parastatals? Why making a monopoly out of a private company owned or formed by Tony Okoroji and a few of his friends? Most importantly, if COSON fails to deliver (like it has started to fail) on services, where does the average Nigerian musician turn to for quality or comparative services? This is the real issue on ground. Even God gave us the right ti decide btw good and Evil

An insider just told me now that the Cross River State government is also going to ban all COSON members works at the” Calabar Carnival”. Any musician who wants to be part of it should make sure their name is not on that list. Could this be the road to the fall of COSON or Okoroji’s + NCC’s Empire?

Some of us joined COSON because we were told we had money to collect and the only way we can get it is if we join COSON, only to be given 12k after signing some documents and they gave us one bag with jotter inside and pamphlet and since then nothing else. Even they said they share N100 million we no see nothing. What a blackmail because we broke and needed money we sold our soul to Okoroji and NCC officials are part of this scam. Thank you BON and IBAN. I will write and withdraw my copyright from there. You can use my music please until we have another collecting society if those NCC greedy Civil Servants will approve another for us. COSON is for NCC we need another one for ourselves. I heard the Federal High Court told COSON not to distribute the 100 Million when it was announced but they still went ahead because they wanted to cover up the questions that people will ask. Now I hear NBC wants to join hands with NCC to resolve this wahala but we know NCC is a major party in this whole saga because of their personal interest in COSON so who do they want to fool with all that meeting? NCC want to become a judge again in its own case. NIGERIA ooooooOOOO!!!!

BON/IBAN please everything down until we get the accounts of How much every broadcaster have paid so far, how much all the hotels in Nigeria and restaurants and advert agencies etc have so far paid and how did COSON use and who did they distribute it to. I have read and heard many commentaries on both side of the divide, most of which were emotional and play on the psyche of our artistes “NIGERIAN MUSICIANS” who are usually at the receiving ends of such actions as represented by COSON and decision as made by BON/IBAN not to play Nigerian music “under COSON’s control”. That is how they punish us and made us come out at the National Theatre and went on “Hunger Strike” under the umbrella of The Nigerian Music Industry / Nigerian Musicians to fight piracy not knowing it was a ground and grand plan of Okoroji to get members for COSON. The very annoying part of it all was that while we went hungry everyday these people “at the TOP” went to hide themselves and were eating Mr. Biggs and Sweet Sensation Rice and Chicken ( this is not funny at all Linda) and until we caught them one day and that was how we ended the so called hunger strike. How long will they continue to use us? They only call us when they want to fight and when they settle they abandon us. We shall resist it this time. Efe and his small group can go ahead alone please Okoroji as the General while NCC officials are the area boys after collect our money and collecting salary from Government again – our tax money.

All you fake anonymous commenters who have no part in COSON yet claiming to be members, if you have any issue with your society, why have you not gone to the office to lay your complaints. Why have you chosen a blog page to air your views on matters that concern your livelihood. If COSON collects money that belongs to you and someone is misappropriating it is a blog page the right place for you to get your case redressed. Stop decieving yourself and the public. You cannot do wrong and cover up by painting some people black.

Please pay musicians their royalties and stop this divide a rule tactics. BON/IBAN in the days of MCSN/PMRS said two societies created confusion for them and so they did not know who to pay to. Now you have COSON they come out to say the monopoly is now killing them they cannot pay. So at what point will it be convenient for them to pay. STOP DECEIVING THE PUBLIC PAY YOUR ROYALTIES. Does this bingo know that the name COSON was coined and agreed upon by major stakeholders in the music industry. Does he know that before the approval of COSON, all parties were asked to present their document to see if they truly meet the requirements to run CMO for music in Nigeria?
he claims NCC works for Okoroji; but COSON was approved by an MCSN lawyer and MCSN staunch advocate (can he deny this?).
Does he know that both MCSN and COSON officials agreed to the name COSON? That MCSN was given an opportunity to join forces with COSON to form a united body after the latter met the requirements.

The first celebrated fraud Okoroji committe was when EFE was still in primary school. General Babangida gave PMAN 35 hectares of prime land and 10 million Naira (one Naira to one USD then), Okoroji miss maned the mone, no accounts and lost the land due to no development. General Babangida gave MUSON on Teemac's request a land near the Onikan Stadium (love gardens) and 10 million Naira. MUSON has become the most profitable non- profit organization in Nigeria. The Shell and Agip hall, the bank and the Restaurant are yielding MUSON more than 3 million Naira a day. They can spend the surplus on the MUSON Music school. Okoroji has been a know personality in the Entertainment Industry, known for his illegal dealings, it is time that EFCC investigates him and if COSON wants to survive, he has to be immediately fired.
