Must read! Chimamanda Adichie writes on the anti-gay law

Article written by award winning writer Chimamanda Ngozi Adichie titled 'Why can’t he just be like everyone else?'  Find it below...
I will call him Sochukwuma. A thin, smiling boy who liked to play with us girls at the university primary school in Nsukka. We were young. We knew he was different, we said, ‘he’s not like the other boys.’ But his was a benign and unquestioned difference; it was simply what it was. We did not have a name for him. We did not know the word ‘gay.’ He was Sochukwuma and he was friendly and he played oga so well that his side always won.
In secondary school, some boys in his class tried to throw Sochukwuma off a second floor balcony. They were strapping teenagers who had learned to notice, and fear, difference. They had a name for him. Homo. They mocked him because his hips swayed when he walked and his hands fluttered when he spoke. He brushed away their taunts, silently, sometimes grinning an uncomfortable grin. He must have wished that he could be what they wanted him to be. I imagine now how helplessly lonely he must have felt. The boys often asked, “Why can’t he just be like everyone else?”

Possible answers to that question include ‘because he is abnormal,’ ‘because he is a sinner, ‘because he chose the lifestyle.’ But the truest answer is ‘We don’t know.’ There is humility and humanity in accepting that there are things we simply don’t know. At the age of 8, Sochukwuma was obviously different.  It was not about sex, because it could not possibly have been – his hormones were of course not yet fully formed – but it was an awareness of himself, and other children’s awareness of him, as different. He could not have ‘chosen the lifestyle’ because he was too young to do so. And why would he – or anybody – choose to be homosexual in a world that makes life so difficult for homosexuals?

The new law that criminalizes homosexuality is popular among Nigerians. But it shows a failure of our democracy, because the mark of a true democracy is not in the rule of its majority but in the protection of its minority – otherwise mob justice would be considered democratic. The law is also unconstitutional, ambiguous, and a strange priority in a country with so many real problems. Above all else, however, it is unjust. Even if this was not a country of abysmal electricity supply where university graduates are barely literate and people die of easily-treatable causes and Boko Haram commits casual mass murders, this law would still be unjust.  We cannot be a just society unless we are able to accommodate benign difference, accept benign difference, live and let live. We may not understand homosexuality, we may find it personally abhorrent but our response cannot be to criminalize it.

A crime is a crime for a reason. A crime has victims. A crime harms society. On what basis is homosexuality a crime? Adults do no harm to society in how they love and whom they love. This is a law that will not prevent crime, but will, instead, lead to crimes of violence: there are already, in different parts of Nigeria, attacks on people ‘suspected’ of being gay. Ours is a society where men are openly affectionate with one another. Men hold hands. Men hug each other. Shall we now arrest friends who share a hotel room, or who walk side by side? How do we determine the clunky expressions in the law – ‘mutually beneficial,’ ‘directly or indirectly?’

Many Nigerians support the law because they believe the Bible condemns homosexuality. The Bible can be a basis for how we choose to live our personal lives, but it cannot be a basis for the laws we pass, not only because the holy books of different religions do not have equal significance for all Nigerians but also because the holy books are read differently by different people. The Bible, for example, also condemns fornication and adultery and divorce, but they are not crimes.
For supporters of the law, there seems to be something about homosexuality that sets it apart. A sense that it is not ‘normal.’ If we are part of a majority group, we tend to think others in minority groups are abnormal, not because they have done anything wrong, but because we have defined normal to be what we are and since they are not like us, then they are abnormal. Supporters of the law want a certain semblance of human homogeneity. But we cannot legislate into existence a world that does not exist: the truth of our human condition is that we are a diverse, multi-faceted species. The measure of our humanity lies, in part, in how we think of those different from us. We cannot – should not – have empathy only for people who are like us.

Some supporters of the law have asked – what is next, a marriage between a man and a dog?’ Or ‘have you seen animals being gay?’ (Actually, studies show that there is homosexual behavior in many species of animals.) But, quite simply, people are not dogs, and to accept the premise – that a homosexual is comparable to an animal – is inhumane. We cannot reduce the humanity of our fellow men and women because of how and who they love. Some animals eat their own kind, others desert their young. Shall we follow those examples, too?

Other supporters suggest that gay men sexually abuse little boys. But pedophilia and homosexuality are two very different things. There are men who abuse little girls, and women who abuse little boys, and we do not presume that they do it because they are heterosexuals. Child molestation is an ugly crime that is committed by both straight and gay adults (this is why it is a crime: children, by virtue of being non-adults, require protection and are unable to give sexual consent).

There has also been some nationalist posturing among supporters of the law. Homosexuality is ‘unafrican,’ they say, and we will not become like the west. The west is not exactly a homosexual haven; acts of discrimination against homosexuals are not uncommon in the US and Europe. But it is the idea of ‘unafricanness’ that is truly insidious. Sochukwuma was born of Igbo parents and had Igbo grandparents and Igbo great-grandparents. He was born a person who would romantically love other men. Many Nigerians know somebody like him. The boy who behaved like a girl. The girl who behaved like a boy. The effeminate man. The unusual woman. These were people we knew, people like us, born and raised on African soil. How then are they ‘unafrican?’

If anything, it is the passage of the law itself that is ‘unafrican.’ It goes against the values of tolerance and ‘live and let live’ that are part of many African cultures. (In 1970s Igboland, Area Scatter was a popular musician, a man who dressed like a woman, wore makeup, plaited his hair. We don’t know if he was gay – I think he was – but if he performed today, he could conceivably be sentenced to fourteen years in prison. For being who he is.) And it is informed not by a home-grown debate but by a cynically borrowed one: we turned on CNN and heard western countries debating ‘same sex marriage’ and we decided that we, too, would pass a law banning same sex marriage. Where, in Nigeria, whose constitution defines marriage as being between a man and a woman, has any homosexual asked for same-sex marriage?

This is an unjust law. It should be repealed. Throughout history, many inhumane laws have been passed, and have subsequently been repealed. Barack Obama, for example, would not be here today had his parents obeyed American laws that criminalized marriage between blacks and whites.
An acquaintance recently asked me, ‘if you support gays, how would you have been born?’ Of course, there were gay Nigerians when I was conceived. Gay people have existed as long as humans have existed. They have always been a small percentage of the human population. We don’t know why. What matters is this: Sochukwuma is a Nigerian and his existence is not a crime.

I have always loved u to bits Chimamanda, but I disagree with you on this one. You have made valid points but let us realise that if we keep quiet on this matter, generations after us may see homosexuality as the norm rather than the exception. Yes homosexuality has always been in existence but it is now on the increase because we did nothing about it in the past. I feel bad for the likes of Sochukuma, who found themselves the way they are but what of the straight guys who are switching lanes? I don't fear about us, I fear for our children.

Nice writeup but I don't agree with the premise. Sochukwuma obviously needs help psychologically n other ways 2 correct such imbalances if not, he would definitely sort after able-bodied and virile men who will love him like a woman.
The problem now is the growing % of such able-bodied and virile men that would be engaged to Sochukwuma and co to the detriment of the essence of creation.

Although I used to be anti gay based on my religious stance, however, it never did occur to me that criminalizing gay acts was inhuman and unjust. Thanks for the enlightenment girl, God bless you.

As much as there are lots of reasons not to discriminate against gay,i really dont think we should be force either to make a choice of those we should talk to either.....among this popular figures and celebrity. i can smell a rat when they support this gay stuff...i tink they do it with lots of pretence and they re not sincere...bcos we have other issue of governance bordering us does not mean we should accept what is strange to us.....how will you feel if a 14year old boy is raped by another man bcos he has abnormal feeling?????????????

(d case of the having sex was never of d increase) but with the increase in the worlds evil, you all now fight, lets legalize abortion, premarital sex, gay married e.t.c.

Nice write up Chimanda...one question though. Why is doing drugs a crime? I mean consuming it by a well consenting adult who thinks that that is the best way to live and enjoy his life? If you say health hazards, who is he hurting but himself? Answer..The West doesn't think its normal and so either locks them up or tries to rehabilitate them. By God I love everybody equally, gay or not BUT in noway thinks the act should be encouraged or forced down our throat like the world is trying to. The law maybe a harsh option but I tell you if the West didn't start making it look fashionable and almost as important as education, must of us wouldn't even avert our mind to it. Nigeria like most other African countries took the step they did in other to forestall the West from turning our society to what they have turned theirs into. Whether they are developed or not, America is a place of moral and social lawlessness.

Good write up and I must say, very thoughtful. I agree that the law is uncalled for but sadly many Nigerians will read this article in the morning and still be stubborn headed to reasoning. why? because w are in a society that is still disillusioned by the doctrines of religion.
Developed countries in Europe went through dark periods like ours where women suspected to be witches were either stoned or burnt to death in the glare of the public, so did homosexuals too but through struggle from the control of the church, people emancipated themselves mentally and today this countries have displayed interest in the protection of rights of every citizen notwithstanding their background, even animals!
But I am against the part of her write up where she said that a law is only passed against activities that are criminal natured. Recently the Lagos state government signed the law prohibiting citizens from smoking in public, and for those who want to quickly criticize, such law has already been passed long ago in some developed countries. Now a law can be passed against activities that are harmful to the health of others, or even of negative influence. I believe the primary focus of the Anti gay law is to steep its influence especially on our gullible young population who seem to accept any trend as pop culture. We are already seeing it in entertainment mags and blogs with popular people coming out of their closets, and remember, that these famous guys have a strong influence.
Whether you like it or not we live in a society where God is given the high accord as the author and finisher of our faith. But we are also very gullible to the influence of high profile men, especially religious ones who tell us to jump in a well and we all excitedly oblige.
The issue of the Anti gay law is a very delicate matter but also one should not be fooled to believe that it is an issue that demands one to be for or against. One needs to take time and critically examine both arguments because I believe that there are always different sides of a story.
But I will still reiterate that Nigerians should emancipate their minds from mental slavery and cease to continue allowing others think for them, instead, they should imbibe the habit of thinking critically rather than just going with the crowd. ONE NIGERIA!

As much as I greatly admire and respect the writings of Adichie, I vehemently disagree with her position on the Gay law. We live in a country notorious for racing after the fad. We copy and copy however bad what is being copied is. The current fad is same sex relationship and we like before are copying again..

I am not bothered about what the fad is in the US or Britain or France or any part of the world, I am bothered about the position of God on it and His original plan for man. God condemn same sex relationship and for me that put an end to the arguments against the Gay law. If God had allowed it in Sodom and Gomorah, then there would have been no reason not to allow it to flourish in the world but because of sins like this, God destroyed Sodom and Gomorah.

Adichie must remember that the law is the law. Reason and common sense might be overthrown by the law but reason and common sense must never be allowed to overthrow the law or our whole society would become like a tatami. The law might appear stupid to some people now but without this law, Nigeria will be taken and consume by the gay world.

I know some folks in primary school as well who had a knack for taking what didnt belong to them! We also didnt exactly have a word for them for we knew not kletomaniac @ the time! But thank God there is a law against theft, whether you were born a klepto or acquired it, whether klepto are minority or not.
As for Sochukwuma, I must say he wasnt gay @ the time and if he was removed/re-programmed he wouldnt turn out gay.

However, there are concerns to the content.Democracy and law is often times measured by what Americans and British have defined leaving the rest to follow or be labelled anti democratic governance. A society is free by standard to define what constitute their rule of law. In Igbo settings which to me is one of the old democratic reference point, there is what is referred to as "aruh" or "taboo". Morally gay is abnormal. Medically, it is anti procreation and also harmful, physically, it is repelling, spiritually, it is a sin and culturally, it is aruh. As a lawyer I can tell u that no human right is absolute,else there won't be law and order in a society hence they all have an exception. Inasmuch as I respect the the thoughts of Chima, it still does not take away the fact that each society has a right to enact laws that a congruent with heir beliefs.

The fact that underdeveloped countries like ours make laws that are not in line with what the west believes should not be the basis of this criticism. Thank you. Nigerian government have misplaced priorities. That being said, I was sexually abused as a child and you know it is a chain you teach other children. Doing girls was never an issue but as I grew I realised I was straight. I wasnt attracted to Ladies.

I remember Ijanikin, two girls from my set were beaten because of same sex. I wish we knew then.

In my life, I have met people who are gay and amazing. They are normal people like you and I. Let's give them a chance not to marry opposite sex for show up

Its nice and convincing. It doesn't make Homosexuality acceptable or a different kind of normal. Also as Christians let's not be found as adulterous or fornicators lest we receive the same punishment as gay people.

The worst thing about this law is that it would teach our children hate. When they study in school and are taught to be close minded, ignorant and hateful of other human beings. Nigeria has taken a huge step backward in a time when others are being more tolerant. Too bad

This is very deep and thought provoking with many, many insightful ideas. I am not promoting homosexuality but I have no idea what it feels like to be gay so who am I to judge or condemn. I say let us live and let live, let us show each other love and if homosexuality is wrong, let God be the judge not us. In the mean time let's treat each other with respect and perhaps that could encourage change, that is, if change is truly needed

“A crime is a crime for a reason. A crime has victims. A crime harms society. On what basis is homosexuality a crime? Adults do no harm to society in how they love and whom they love.” - I used to be very homophobic and loved the anti-gay bill but damn! Those lines struck me. I'm begining to see these gay thing from an entirely different angle.
