Code of Conduct Tribunal issues fresh arrest warrant on Saraki

Chairman of the Code of Conduct Tribunal, Danladi Yakubu Umar, has issued a fresh arrest warrant on Nigerian Senate President, Bukola Saraki, after he failed to show up at the tribunal this morning. Are they not aware that the Court of Appeal granted a stay of execution order on their arrest warrant?

The court of appeal is on the same hierarchical level as the code of conduct tribunal and as such they are not obliged to follow that order. It's only an higher court that can give a stay of execution order to the cct

This code of conduct tribunal is just making a fool of itself. How many times are you going to send arrest warrant? If you want to arrest the Senate President, do it without much drama. But the question on everyone's mind is why has it taken so long for them to issue this warrant. Assets that were declared more than ten years ago, it is now they are finding discrepancy?

@ Linda: With utmost respect and humility, I am a super fan of your Blog but will not hesitate to correct your view when the situation arises. Kindly confirm before concluding. When did the Justices of the Court of Appeal Sit let alone grant his application for Stay between Friday (when the CCT issued the Bench Warrant ) and Monday (when two matters are coming up before before two Courts viz. CCT and FHC)? He has only filed an Appeal and his application for Stay stands as only filed until moved and granted by the Court of Appeal. However, he ought to file his application for Stay at the CCT first before going to the COA. It is only when the CCT refuses his application for Stay that he can then proceed to the COA appealing the refusal of grant of Stay and urge the COA to grant it. Its what we call procedural law. The COA itself is overburdened with several Appeals which are still pending before it which they are yet to even issue Hearing Notice not to talk of rushing to sit over an Appeal filed on Friday and Order Stay immediately (how I wish our judicial system works that way though). In addition, filing a Notice of Appeal does not operate as a Stay of proceedings or execution.

At this point,I think am right to conclude CCT chairman is making fun of the process.and obviously acting out a script. Bukky will resist any attempt to hijack the senate.Dullardinho will not be allow to rule by indirect-decree. Its Democracy babe.

The judiciary system in Nigeria is messed up. A house standing torn against each other.

Nigeria Criminal Justice System is a Sham! Court injunction, stay of execution order and arrest warrant. Who on earth can argue this sort of criminal Justice system can convict any highly placed criminal?! If U like be a SAN, Lacasera or Fan Yoghurt!

The CCT has a right to summon Saraki. The longer this goes on the more Saraki loses credibility here and abroad. He is proven to us he is nothin g but a corrupt rogue.

If Arase if afraid to arrest Saraki, then the IGP should be fired. It is an indication that he doesn't understand the law he swore to enforce or he his complicit-meaning Saraki has bribed him.

I beg to disagree. In my humble opinion, as long as you have applied to COA and can prove you have applied via the court clerk, then a stay of execution will stand.
