Keyamo examines the legal implications of the death of Prince Audu

Read the press statement from revered lawyer Festus Keyamo below...
The reported death on Sunday, November 22nd, 2015, of the APC candidate in the Kogi State Governorship elections, Prince Abubakar Audu, is extremely shocking and sad. I would like to express my condolences to the entire family of Audu and to the people of Kogi State. However, the real question agitating the minds of everybody is the legal implication regarding the inconclusive Governorship elections at the time of his demise.
To state it correctly he was said to have died AFTER the announcement of the results by INEC and after INEC had declared the elections inconclusive. Admittedly, this is a strange and novel constitutional scenario. It has never happened in our constitutional history to the extent that when an election has been partially conducted (and not before or after the elections) a candidate dies. What then happens? This is a hybrid situation between what happened in the case of Atiku Abubakar/Boni Haruna in 1999 and the provision of section 33 of the Electoral Act, 2010.

In the case of Atiku Abubakar/Boni Haruna [which is now a clear constitutional provision of section 181(1) of the 1999 Constitution (as amended)] the Supreme Court held, in effect, that “if a person duly elected as Governor dies before taking and subscribing the Oath of Allegiance and oath of office, or is unable for any reason whatsoever to be sworn in, the person elected with him as Deputy governor shall be sworn in as Governor and he shall nominate a new Deputy-Governor who shall be appointed by the Governor with the approval of a simple majority of the house of Assembly of the State”.

In the case of section 33 of the Electoral Act 2010 it provides, in effect, that if a person has been duly nominated as a candidate of his party and he dies before the election then the political party has the right to replace him with another candidate and not necessarily the Deputy Governorship candidate. Now, does the Kogi situation fit into section 181(1) of the Constitution as quoted above or section 33 of the Electoral Act mentioned above?

My simple position is that the Kogi situation fits more into section 181(1) of the 1999 Constitution (as amended) and as such James Abiodun Faleke automatically becomes the governorship candidate of the APC. This is because even though the election in inconclusive, votes have been counted and allocated to Parties and candidates. As a result the joint ticket of Audu/Faleke has acquired some votes already. James Abiodun Faleke is as much entitled to those votes already counted as much as the late Abubakar Audu. He has a right to cling to those votes going into the supplementary election. There is only one problem, though. Who nominates Faleke’s Deputy? Unlike section 181(1) of the 1999 Constitution, he cannot approach the House of Assembly of the State to approve a nomination by him of a Deputy. This is because, in reality, he is not duly elected yet.

Therefore it is only reasonable to conclude that it is APC (Faleke’s political party) that should submit the name of a fresh Deputy Governorship candidate to INEC for the supplementary election. This is the only position in this situation that accords with reason and good sense.

FESTUS KEYAMO, ESQ. London, 9:40pm Sunday, November 22, 2015.

Wrong! Because Aufu wasn't sworn in already, APC will have to conduct new primaries for their guber candidate and the elections must be re done in Kogi!

THEY ALREADY KNEW WHO WILL RULE EVEN BEFORE ELECTION IS WON. May Your FriEndnemis never use you this way. They shall fall in their own pits. Any pit dug for you, the digger shall be the victim!!!

Thanks for this momentus analysis Mr Festus K. We hope this isn't going to bring about another drama in the political sphere.
I am sure that if the party isn't confident about the candidacy of Fakeye for whatever reason, the section 181(1) quoted above may never be upheld. The law indeed is an ass!
It will interest everyone to know that only the Laws of God has is perfect and need no amendment.

I beg to differ with your assessment of this situation. The Constitution says if a person is "duly elected". I emphasize the word duly elected, because in other for a person to have fulfilled this criteria, he must have been declared the winner of the election by the electoral body(INEC). Audu was not declared the winner of the election before his death, so this argument cannot and should not hold.

The law is an ass, confusion will start now and PDP will start claiming what is not their right

Thanks for elaborating.

Keyamo God bless you. for this simple explanation. When I heard the man 'fall down and died' after the result of the election was declared inconclusive, what came to my mind was a JK Rowling novel. 'The casual vacancy' lol if you've read that novel then you will know why this was my first thought. Then the next question was who will succeed him, after all the election was declared inconclusive, will there be another election from the scratch? will the deceased's deputy be allowed to ascend the throne as governor lol in an election that was declared inconclusive... or will the baton of leadership cross automatically to the political party that came second in vote counting in this inconclusive election. a lot of crazy thoughts cross my mind that could actually make a good best seller novel. But this simple explanation just put things in place for me. Thank you. Good to have brilliant people in the hem of affairs.

This scenario does not fit into any of these sections of the constitution u quoted, true the has never been a situation like this in thie history of Nigeria politics, but my take is that whe few ppl a in a competition and the first person is in one way or the other out of the copetition, the second to him becomes the first.

In the case of Abu baker Atiku/Boniface Haruna, Atiku has been elected and election process completed...in the case of Abubaker Audu, Audu is not yet elected and the election process not completed NO ONE HAS BEEN DECLARED. Election is a process that ends with declaration of a winner!
Keyamo's submission is wrong! The Act provides that if one dies before the completion of the process his party has the right to provide another candidate...why is Keyamo introducing confusion.

If the aim of this election is to let the Kogi people say who they want to be their Governor then the inconclusive election should be cancelled for a fresh one. This is because the Igala people who are the overwhelming majority people of Kogi state were voting for their brother Audu Abubakar to be their Governor and not for Faleke from the minority Okun Yoruba tribe. Kayemeo is wrong and knows so but had to accept the brief to lend his popular name to the argument that favours Okun interest.

Keyamo, who asked for ur useless opinion? U are stylishly advertising your services which is against legal ethics? Are u the only lawyer in Nigeria? Why can't u allow the the family and the state to mourn his death before coming out with ur spurious argument? How could u say that the the real question agitating everybody's mind is that of succession barely 2 days after he died? Do u think everybody is insensitive like u are? My God, allow them to mourn him first. Have respect for the dead!!

You are a big fool!!!!

this position is wrong because the election was inconclusive and the man hasn't been sworn in. furthermore the party has a right to choose who takes over their flag and stand in place of the deceased. in my opinion the second runner up in the primaries should be substituted for the dead man and if he likes he continues with the current deputy. or i will rather they go to court.
