We suspended Dana licence in error – Federal Government

The Federal Government on Friday admitted that the suspension of the Operating Licence of Dana Airlines immediately an aircraft belonging to the airline crashed on June 3 was against global aviation practices.

The FG said the best it could have done then was to isolate the particular aircraft involved in the crash and carry out the necessary investigations.

Minister of Aviation, Mrs. Stella Oduah, gave the explanation on a Channels TV breakfast programme. She was reacting to the strong condemnations from the family members of the victims of the crash, after the FG restored the airline’s operating licence on Wednesday.



The FG had suspended Dana’s licence on June 5, 2012, two days after its Abuja-Lagos flight 0992 crashed into residential and commercial buildings in Iju-Ishaga, on the outskirts of Lagos, killing 153 passengers and crew on board.

But on Wednesday, the FG lifted the suspension, saying it was satisfied with the air-worthiness of the airline after a rigorous technical, operational and financial audit.

The decision, however, attracted criticisms from those affected. The victims of the crash, claim that their agony has been worsened by the fact that the government restored the licence even when investigations into the crash are yet to be completed and the remains of some of the deceased are yet to be buried.

To them, Dana Air, which they accused of negligence, should not be allowed to fly any of its aircraft in the Nigerian airspace.

But Oduah explained on Friday that it was against best practices to ground an airline because of a crash.

She explained that what was allowed in the aviation sector was to segregate an aircraft and conduct an audit.

She said the decision to restore Dana’s licence was taken with a sense of responsibility, adding, “a firm cannot be indicted until the results of investigation are released.”

She said, “Rather than indict it (Dana), the result clearly showed that the airline is one of the best in the country today.”

She, however, added that the lifting of the suspension did not translate to the fact that the airline would return to the air immediately.

She explained that the airline must still undergo the process of recertification.

She said, “There is no perfect firm or organisation and that is why we started with institutional reform starting from the Nigerian Civil Aviation Authority.

“Dana is not a perfect company by any means just like any other firm.

“Dana’s manuals, log book and administrative policies are all in compliance with the NCAA rules and regulations. We’re satisfied that thorough investigation was carried out and that was why we said they can go back to work.”

When probed further, the minister said the government would not hesitate to apply appropriate sanctions once the final result was released and the airline found culpable.

She said once completed, the report, being a public document, would be widely publicised for every concerned individual and group to access.

When asked to give an insight into the cause of the crash since she claimed the preliminary report was out, the minister said the remote cause was “very technical.”

“I don’t know the cause of the accident but I know what is not the cause. The accident was not due to NCAA’s lack of responsibility and it was not due to Dana not doing what they ought to do,” she explained.

Oduah added that despite the clean bill of health, the FG was still strengthening the NCAA to ensure it performed better.

The minister expressed surprise that relatives of some of the victims of the crash were yet to receive their compensation because she had held meetings with the airline and the insurance firm on the issue.

Meanwhile, the President of the Nigeria Labour Congress, Mr. Abdulwahed Omar, has said that organised labour did not have anything against the restoration of Dana’s licence.

He said there was nothing wrong if the decision was based on the findings by engineers and technicians, who found the aircraft airworthy.

However, a human rights activist and lawyer, Mr. Jiti Ogunye, described the lifting of the suspension as shocking and insensitive.

Ogunye is among many Nigerians who have condemned the action of the FG, coming about three months after the tragedy.

He questioned the rationale behind the action, saying that the report of the audit should have been made public and a re-certification effected before the announcement.

Besides, he said several unresolved social, financial and emotional issues still surrounded the incident, adding that the regulators and the government should have exercised restraint in taking such an action.

He said, “This is another step that has shown that the government expects Nigerians to take responsibility for their lives. If you fly, you fly at your own risk, that seems to be what they are saying.

“This undermines the safety of the aviation industry. The people affected by the June 3 accident have not been compensated; the coroner’s inquest is inconclusive and they are saying the affected airline can continue operation. The law has not been allowed to take its cause. It is unfortunate.”

Another lawyer, Mr. Kunle Fadipe, said that except the FG tackled the allegations of neglect and bring the culpable persons to face the law, it would not be seen to have done the right thing.

Fadipe said, “I don’t understand this haste. There are issues to be resolved. Emotions are still very tense on the part of several affected families and you want Nigerians to start flying the airline so soon?

“Government and regulators should have allowed emotions to calm down; some people have not even buried their dead. It is very surprising.”

I can remember how I felt the morning after the crash, my eyes welled up in tears as I forced myself to get out of bed that morning. I didn't know anyone personally that died but my heart cried out for them. Imagine how I feel now how willnd families feelnabout this. Bribery and corruption wudnt kill our country. Thunder fire stella oduah if her son was on d aircraft am sure d owner wud be in jail by now.

Hmmm their lawyers must have come down hard on the naija govt. We can not sensationalize the matter. The law is the law you guys. I understand where this might be coming from and before you all come with only in nigeria and anything goes, this is actually one of the few times they are now following the law. I lost family in the crash too so I am not taking sides. I am still hurting but her explanation makes sense. The issue I have is did they really carry out all the intense investigation of the rest of dana's craft before allowing them to fly again? That is the problem I have

I can confidently say we have demons for leaders!!!This air crash was not an accident it was involuntary manslaughter!The Dana people knew the aircraft was faulty yet the allowed 154 people to board and the eventually died.This is painful.HOw can these leader be so heartless.SO all of a sudden they want to follow global air practices?All of a sudden they want to be lawful and follow rules. Why were they not following global practices for aviation checks and procedures on planes....Our nation is seriously doomed!!

To my own conclusion based on my experience with many airlines in Europe..yes this woman is quite right with the FG decision because the airline have the right to even sue the govt if they hadn't raised the suspension but in other way round the state of aviation industry in Nigeria is very scary for FG allowing old school planes which you can't even find anymore on the parking terminals of other big countries like Nigeria except the airport museum running on the Nigeria airspace risking people's life everyday...So therefore if you really love your life in Nigeria i think ABC and other road coaches are the best for now because they even have a standard insurance policy working for them.

A lot is goin thru my mind....trying †o weigh and balance d Fed govt's reasons....my problem is dis, at every instance our ministers and co keep telling d world how incompetent they are, if its against world practices den why did dey make d mistake in d 1st place...we keep talking of global practices and standards when we dont meet up and choose †o neglect dese standards, d preliminary inquest clearly shows dt der ws negligence and total disregard for human lives and safety practices in ds case and I feel dey shld Ħa√ع left Dana in suspension subject †o d findings from dere final investigations after which dey can allow dem operate or seize dere license, may God give us d strength †o overcome all dese flaws and direct our paths †o peace.

I am sorry for the victims and i know quite a few in d crash but I remember vividly d Airfrance Airline dat crashed. Their Airline was not banned. Also I was to travel with Turkish Airline sometime in 2008. One of their plane crashed just two days before I was to travel and I still travelled on my date of departure. I think we shd focus more on making those in Authority to carry out more investigation on d crash rather than wasting energy on abusing d woman. May d souls of d departed rest in peace. She is quite right to say that they suspended the licence in error because they should never have done that in the first place. It's never done anywhere else in the world, except in Nigeria of course. She even made it worse by saying it was done out of sentiments, this only goes to show how incompetent most of our leaders are.

There is a government body that audits airlines within the Nigerian airspace, the NCAA. The NCAA is meant to carry out audits as often as it deems fit on all airlines, vouching for their compliance to all air safety regulations. Suspending the airline amounts to an indictment of the NCAA and by extension the government. The incompetent minister and her advisers must have realised this and made a u-turn.

I would have thought that while the AIB was carrying out its investigation, the ministry would have looked into the activities of the NCAA to determine if its staff was actually carrying out its duties.

Sentiments apart, no one can say they know why the plane crashed. However if there are any such people, they should make themselves available to the investigators. If DANA airlines is found wanting, then its licence should be withdrawn and all persons involved must be prosecuted ditto for persons found wanting in NCAA. If not they should be left to fly(trust most naija peeps not to fly them though). After all under the law, you are not guilty until proven guilty.

The reality of the situation is that our leaders are clueless, hopelessly greedy and morbidly insane. Expecting anything better from them only puts us on the same pedestal of malady.
In the absence of a socially responsible government, let's unleash our powers as citizens on DANA AIR.
Without CUSTOMER PATRONAGE, Dana air is doomed to die. I urge you all to BOYCOTT this airline of death and mass murderers.

How do we know it will not happen again??? What did the black box say??? Who Or what was responsible??? Why have some corpses not been released to their loved ones??? I have always bn proud of naija no matter the crime bn committed in regards to 419, but the recent dying of innocent souls by boko and plane crash is becomin alarming and it gets on my last nerve when the fools we call our leaders are not doing anything to protect their citizens. This goes on to confirm the rumour that the crash was indeed caused by the First Lady and her entourage, who ordered the Dana aircraft to hover in the air until her flight took off. This is why the black box was never released. Dana airlines wasn't culpable as we initially thought, so I guess the FG ultimately had no choice

As sad as the situation is, as insensitive as our leaders can be, I do agree that Dana air was one of the best airlines in Nigeria. We lost so many good people on that flight because in truth, they were the most trusted. I still cannot fathom how a non technical official would okay a faulty aircraft to fly but let's also remember the accusation that madam dame caused the flight to hover for quite some time. Why has the inquiry been halted, why is government keeping everything hush hush? His is no justification but bellies has crashed and killed over 100 people in 2005, today they are still flying.

Our leaders are just incompetent, they are just a bunch of jokers, with no care for our lives.

Even with this development I just wonder now Dana will gain the trust of Nigerians again. I advice that they come out with a proper press statement, run tests on all their aircrafts(with some government officials on board) and televise certification reports by professional oyibo(yes o, it's only their opinion we will trust) technicians. Hope they fare well and may our brothers and sites on the ill fated flight continue to rest peacefully. Amen

After a committee was formed to look into the cause of the crash and they couldn't arrive at anything or provide a reliable feedback, they are telling us Dana Operating licence was taking in error. May God save us from these inadequate, insufficient and incompetent savages of representatives that parade thenselves around the government for their selfish interest.

Avoid this airline. That is the only power we have. We know the truth and that all this is wrong and not in our best interest. Leave them, let them continue to enjoy blood money.

When their greedy arses stop making money and see no passengers, they will stop flying.

Pls don't be tempted by marketing, promotions or even free flights sef. Let's not forget what they have done. There's power in the masses. This is the only thing we can do, let stick together on this.
