Man on trial for failed suicide attempt

You see this yeye people? Should this man be in court or in an institution where he can get help? This is the same way Afeez was beaten up in Surulere for attempting suicide. Some people need to be enlightened sha. Below is how Daily Times is reporting it...
A 36-year-old man, Ekanem Aniefiok, was on Tuesday arraigned before the Karu Magistrates' Court for alleged attempt to commit suicide.
The police Prosecutor, Umar Mohammed, told the court that Aniefiok, of the Federal Housing Authority Estate, Karu, Abuja, committed the offence on September 4 at 10am.

He said the offence was contrary to section 75 of the penal code law.

According to him, the police was alerted by one Idika Uzoma, of the same address, that the accused had attempted suicide.

The prosecutor said Uzoma had discovered Aniefiok hanging in his room while his 20-month old daughter was holding a part of the rope that went through the ceiling.

Mohammed said that the accused was unconscious while the baby was crying, and that Uzoma raised alarm which attracted neighbours who rescued him.

The prosecution said that Aniefiok had confessed to committing the offence because he lost his job and that his wife had abandoned him.

Magistrate Celestine Odo said the court had no jurisdiction to try the accused and advised the prosecutor to refer the case to the appropriate court of competent jurisdiction.

Accused? What crime?! So hilarious, yet I cannot laugh bcos I know the implications of poor mental health..
He needs a psychologist ASAP. And a new job too.. His family should be contacted for goodness sake. Being in custody, being dragged to courts of law & all this media attention will only aggravate his depression & suicidal tendencies! What a cold world!

They are not suppose 2 sue d man bt give him d help he needs.

Anonymous said...

Yes, he should be in court;his life doesn't belong to him and so it's not for him to take. He's only being tried for attempting to take what isn't his.

The police prosecutor is incompetent, as a social worker, I once had a case like that in a hospital ward, the police as an institution really needs to be educated on issues like this. This man lost his job and his wife left him, so his mental state of health was altered. Then some social interventions can be introduced, through casework with him. God bless Africa.

The law holds the sanctity of human life in a very high esteem and so will not permit anyone to take any life, his own inclusive. Furthermore, the state owns your life and you are mearly a trustee that is why the the constitution stipulates instances were your right to life can be derogated upon.

Linda you are so novice . You need to be seriously enlightened before you put up your stories. Journalism doesn't come easy. A lot of work and sleepless nights is put into it. I think you seriously have to start making stride efforts. You are in the Public eye more now in recent times and you need to wield the respect of your readers/"fans".
Yes agreed, the man needs counseling but that shouldn't stop the Law from prevailing. Without Law we are NOTHING.

For sure, he's supposed to stand before a judge for "attempted murder"(although on attempt was on self) it's handled like this all over the world. However, what the Nigerian govt leaves out is the fact that he's supposed to carryout his sentence in a "rehab centre/clinic". I pray God grants him the grace to enjoy life after the "Kirikiri" treatment.

Attempted suicide is an offence in Nigeria, but complete suicide is not.

I know we lack so many things in Nigeria but am baffled to know that "common sense" is not left out OF those things.

our goverments are clueless, lawmakers are senseless and people implimenting the laws dont have sense of reasoning.

i weep whenever i think of situation of things in Nigeria. is only in Nigeria that we dont have therapist/counselor that can "talk people out of their problems". i could remember sometimes ago wen i was loosing my mind, i searched the whole of abuja looking for somebody to talk to, to no avail.

its so pathetic that Nigerians are not even ready for the "change" we've all been clamouring for.

if that man is sentenced to whatever years imprisonment, there is tendency that he would eventually comit the suicide when he comes of prison.

To the so called Jourlists/people saying laws supercides all things;i want you to know that

* laws are made by people and it can be adjusted

* when u're guided by law, you can also use your initiative to tackle issues.

my prayer is that GOD WILL HELP US IN NIGERIA

Well this is sad,dat some 1 would want to take his own life.life is precious and a gift of love from God.though we have a lot of issues that could trigger one to take his life, eg when one is not contend with what he has i.e greed, comparing ursef to another, anger, lost, vanity, attachment.all this are our most enemy which has to deal with oneselve.my advice to the guy is to love his selve, which will radiate to everyother thing in life.he should not also think that taking his own life will solve the problem no.it will surely increase the weight of his load.and to also trust and have faith in God always while surrendering to God. from cyndy.

nawaoooo...wetin prsn no go hear sef!!!!hw d tng come tke concern dem. Na him headache now. Naija i tire.

I think the best thing is to enquire from the guy what the problem was, that will aid him to want to take his life and focus on how to solve this problem by counselling him.let him see enough reason why he should live.Moreso,we have a lot of things that could cause it such as,anger, greed, attachment, lust, and vanity.my advice to the guy is that he should not compare himselve with anther,he should be contend with life,he should love himselve which will radiate to others,he should trust and have faith in God while he surrender all his worries to him.

Nigerians we are sick, that man needs help that is why he is attempting suicide,he needs help not charging to court, what happen to our sense of reasoning, our conscience, our human feelings.we need to have a rethink.God gave us conscience to always have a rethink,he need help not blames

Really! So if he had died would his corpse had been jailed. You are just as foolish as those who took him to Court instead of a mental hospital.

Anonymous said...

See sect 75 of d penal code law. If u dnt find him wanting den I blive d procecutor is crazy. Bt if d section spell out sucide as an offence to d land. I den blive tking him to court is justified. Meanwhile my pple don't forgt that d court is not there to crucify anybody. If dey declare beyond resonable doubt dat d guy needs counselling den d court will pronounce so.

The judge/magistrate shd do him a favour and sentence him to death by hanging *ijs

Suicide is the only crime that the attempt is crime and actually commuting the crime is not( Nigerian Criminal & Penal Code).

Why do we reason back ward?the young man should go for counselling and placed on a medication like antidepressant by a doctor. They are only reinforcing a need for him to commit same suicide once released.

Anonymous said...

Only for naija.

Anonymous said...

Linda, it may be that you have sympathy with the accused from your own conscience. But the fact is that attempting to commit suicide (and I suspect, aiding and/or abetting the perpetrator) is listed as an offense on the statute book (section 75 of the penal code law). It doesn’t exclude the possibility that the judge, on evidence, might order transfer to a suitable institution for counselling. In fact, this is not unique to Nigeria: many judicial systems do consider it a criminal offense simply because it is one form of HOMICIDE (taking the life of a human being, be it oneself’s). On the other hand, beating up anyone attempting suicide is also an offense. It’s mob justice!

Anonymous said...

The trial is right on track. The man is a property of the state, thus has no right to take life including his. However, the judge delivering judgement can decide to institutionalise him. - thelmzz
