State Govt Ban 2-year rent in Lagos. Landlords who don't comply to be jailed

The long awaited Tenancy Bill was passed on Friday August 5, 2011 by the Lagos State House of Assembly and signed by Governor Fashola yesterday August 8, 2011.

The bill basically stipulates that it is unlawful and criminal for any landlord or his agent to demand or receive rent in excess of one year from a new tenant, and rent in excess of six months from a sitting tenant.

Any landlord who refuses to go by this law will be jailed for three years or pay a fine of N100,000.

If you live in Lagos, do you think this will work?

I'm not sure if this law isn't counter productive because it does not stipulate that landlords cannot arbitrarily increase rents. If they decide to do so, whose gonna stop them?

Finally...thank God! You cant be charging 2yrs rent event 1yr sef...how many people receive their salaries 2yrs in advance..lol. However, landlords should use estate agents and make sure tenants get guarantors if they want to rent rather than over charge people.
I believe govt. should also implement standard or quality of homes before people can live in it...e.g wall sockets loosely, hygiene and etc. Becos most landlords dont improve or maintain their houses well and still want to increase rent..it doesn't make sense, the services they are rendering to customers need to be improved before demanding increase in rent.

Goog idea, so long as government puts a guide line on how much the landlord should charge, then no problem, or else landlords would sky rocket house rent.

Gov. Fashola may the Almighty continue to bless you and give you the wisdom to lead us o!

I am the happiest person with this new development: Infact Yoruba Landlords/Landladies (No offence meant) have practically refused to work or earn money any other way as long as they have as little as a shop.

They will feed, clothe and maintain all members of their extended family with the money relised from that one shop.

A shop will go for as much as
N10,000 3years, HABA! wetin Happen? It won't end there o! finish the 3years & increament will be slapped in your face, Pay or Pack out!

I have resolved to deal with my Landlady,& God answered my prayer, this time when my rent expires, na only six months I go pay, any kpeke from her na 2 go report her str8 up! Make we even see small money save!!! Thank God & thank you Gov. Fashola!

well, if he does this, its either to increase rents or landlords wwill say they need their houses in order to get new tenants at a higher rate. Finally if he has to do this, he needs to also enforce a law that states if tenants dont pay at the stipulated time they should be ejected. This is because many tenants who do not pay often take landlords to court and due to several adjournments, rather delay tactics they look for elsewhere to rent.

Peeps, there a law on valuation in Lagos that regulates how much landlords can charge for specific locations. Not many people are aware that this law exists but it does.

i wonder ooo. Y wont ppl cut their cloth according to theri fabric. You wanna live in my house in VI and you dont want to pay the money.. 6months ko 6 months ni. They will not increase minimum wage it is to reduce tenancy..

Fashola should please build more low income houses for people in lagos or else tenants would be evicted for not paying up to 1yr rent. The lanlord will ask you if it was you or fashola that built the house for him or gave him land, they would tell you to ask fashola to provide houses were you can only pay 6months rent but in there own case it is not by force to stay if you can't pat 1 or 2 yrs rent in advance.

Please i need help ooo,i have over 23 tenants that have lived in my house for 2 years without payment after the death of my father.there is this particular tenant called Joseph anya,he has lived in our property for 13 yrs without payment.Mr Joseph anya has added more trouble to my family wahala by inviting my younger ones from different mother to come and stage war against me.My father married 4 wives,the first one was married under the customary/traditional act before the war and had a girl,they both died during the war.he then married the second wife under the customary/traditional act after the war and she had a girl.the third wife was married under the English act/court wedding as she claimed in the 70s,the third wife gave birth to a girl as her first child.the fourth wife was then married after 14 yrs from the year the third wife was married.the fourth wife was married under the customary/traditional act in the early 80s,and she delivered a baby boy for my father after so many years of looking for a son.the second wife moved out and remarried to another man when when she noticed that my father had married the third wife.the second wife daughter gave birth to 2 girl out of wedlock and one of the girls gave birth to a boy out of wedlock.since the first wife and her daughter died during the war,and the second wife remarried without the marriage been properly dissolved and the dowry was not paid back to the people of the second wife till the death of late father.the third wife had 3 children(1 boy 2 girls).the fourth wife had 4 children(2 boys 2 girls).the fourth wife gave birth the to my late fathers first son,while the second wife gave birth to the first daughter of my late father .after the death of my father,the third wife and her 3 children approached our kindred and told to help in sharing my fathers properties according the the native law and custom of our village.the kindred later shared the properties among the children of the remaining 3 wife's(the third wife son represented his mother and sisters and the fourth wife first son represented his mother and sisters.the first son of my late father was asked to represent the second wife family since the boy that was give birth to out of wedlock is a minor)After some months after the properties was shared,the third wife and her children went to court claiming that she and her 3 children are the only ones that will inherit my fathers properties since she was the only one my father took to the alter.now the question is,can that her marriage hold when the second marriage under the customary act was not properly dissolved?what is her chances of winning in court?.what will happen to the 8 remaining children from the second wife and the fourth wife?they second wife is also claiming that the 8 remaining children and the fourth wife are trespassers and she is also claiming 30 million as damages.please advice and send info to dasmo4real2@yahoo.com .i also need help in ejecting the tenants from the property we got.

All u 'orisirisi' people.. How many people can afford the high rents landlords charge? Is he supposed to build houses for 18 million Lagosians and counting? He can only attach the housing issue in phases and I believe this is a step in the right direction (and only

All you 'forward' thinkers, pls tell me how many landlords in the UK or US collect 2 years rent?(They actually collect on a monthly basis). Do they have the kind of housing problems we have?

@Anon 8.30pm. Obviously you really daft or u won't have written the rubbish you did. You are the people that are not allowing progress/ development in Nigeria. Most people can't even afford low end housing in Ajegunle and Mushin cos landlords want 2 years. I can assure you that this law is not really for those in Ikoyi, VI.

It also helps in improving the business environment. How many people can afford to set up offices with the high cost of rent......everywhere. And with no jobs, this doesn't help in encouraging people to be self-employed.

I think we as citizens have a responsibility to enforce these laws that benefit us.

for this to work, lagos govt have to build a low cost hosting alternative, they can't regulate rent on private housing were is that done, it's either you abide by the landlord's rules or you leave it's not buy force. and dis would just either render people evicted or increase the rent. also if i ask for 500k for a yar normally it would be the case of asking for 700k with the mind set of offsetting the fine.
even out here the only reason why private owners can't do that is cos there are other alternatives and competition, its the govt that will build low cost ate estate and sell them at unaffordable price to the mass, also not leaving the on to rent for those who can't afford to sell. this one is madness fashola na u build the house. build lagos housing for this too work
