Notorious kidnapper, Evans, files another lawsuit against IGP, demands N300m in damages

Notorious kidnapper, Evans, has filed another lawsuit against the Inspector General of Police, Idris Ibrahim, challenging his continuous detention since his arrest on June 10th.The lawsuit was filed through his counsel at the Federal High Court, Lagos.

He is demanding N300 million in damages for his continuous detention without trial and being subjected to media trials.


Joined as respondents in his new lawsuit are the Nigeria Police Force, the Commissioner of Police Lagos State and the Special Anti-Robbery Squad, Lagos State Police Command.

In the fresh lawsuit marked FHC/L/CS/1012/ 2017, Evans is asking the court to declare that his continued detention since June 10th without arraignment, violates his fundamental rights as guaranteed under the 1999 Constitution.

Evans is also asking the court to declare that his parade before the media at the Lagos state police command in Ikeja on June 11th by the police was unconstitutional since the police had no court order to that effect.

The notorious kidnapper is asking the court to order the police to arraign him before a court or set him free. He is also asking the court to order the respondents to jointly and individually, pay him the sum of N300 million as exemplary damages for illegal detention and alleged harm caused by the alleged media trial.

Evan is also seeking an order of perpetual injunction, restraining the respondents from further arresting, detaining, harassing, investigating or inviting him in relation to the facts of his case.

The court is yet to assign a judge to the case nor fix a date for hearing of his new suit.

The funny part of it all is that, he's still well within his rights to file a suit against the government. i know you moralists are going to come for me now with the whole "he's a kidnapper! he must die! let him answer for his crimes!"... and i totally agree, but the constitution says a man is innocent until proven guilty. If the senate president can have his day in court, so should a kidnapper. the law should have no respect for any man! Plus the police should either charge him to court or let him go! and please don't tell me they're still gathering evidence. If they didn't have enough evidence to charge him with, why did they arrest him then? As much as we're happy with the police for making such a high profile arrest, their job should not stop there. They should comply with the law to the end. Illegal detention is wrong! be it a terrorist, a kidnapper, or a pickpocket!

It is good for the Nigeria Police Force. Suddenly somebody has reminded them of their job, which is to take Evans guy to court , remand him in Kirikiri and ensure that he rots there. The Nigeria Police Force team in charge of this guy's case has been very childish and behaving unintelligently. Maybe they want to connive with his gang to rescue him ( Vampire style) and then they will say " he has escaped". Sheeo!

In furtherance the grun norm which is the 1999 constitution is clear that every accused person remains innocent until proven otherwise by a constituted court of law. The same 1999 constitution pontificated on the number of hours the Nigerian Police force can detain an accused before arraining him before a law court which remains 48 hrs.otherwise technically it amounts to an act of illegality.
What plays out here is that the Lawyers to the accused seeing this loophole have capitalized on same thereby establishing a level of technicality. Please let us be reminded that law cases are won on technicalities and not on emotions The MPG need to act very swiftly in the best legal direction so as to subvert a seeming legal volcano.

This just shows that our justice system is becoming much more flexible if this man has the rights to file this lawsuit. And in this instance rigid would have been better, because this man might just end up getting a few years in jail and waltz out freely at the end of the day.

This news is really disturbing....i feel Evans is making plans to have his way in the court or in prison(if the verdict is not a death sentence).He does have a point suing for defamation especially by Police force using the media without ensuring the court trial commences soon,but he's insane to think he'll have his way as a criminal.I don't think the police have enough evidence to present to the judge yet,probably the reason for all this. I tire for this country o. You hardly hear news like this in other parts of the world

He has a right to due process. I agrees he should be arraign or be release. U cannot detain him without meeting a judge to tell him his crime and give him chance to defend himself. As a country we have to start following our law or constitutions. If up till now, the police cannot make a case against him in court so probably they don't have any case against him. If someone is a kidnapper and a murderer as we are told and they have evident, they should go to court. They had 48 hour from his arrest according to our law.

Its a show of shame and this case has exposes the pattern Nigeria Police use to extort money from criminals, Evans was arrested almost a month ago and he is yet to be charged to court, there is underground negotiations going on,police is making money while Evans is still under detention,they want to milk him dry He is A billionaire, before taking him to court, then the court will start their own milking,at the end of the day Evans will just like saraki did.
