Pension fraud trial Judge suspended for one year by NJC

The judge who presided over the pension scam trial and gave light sentence to one of the accused persons, has been suspended for one year without pay by the National Judicial Council (NJC). Justice Abubakar Talba of the FCT High Court imposed a mere N750,000 to convicted felon, John Yakubu Yusuf, who stole billions of pension fund.

A statement from the council’s spokesperson, Mr. Soji Oye, read
“The National Judicial Council under the chairmanship of the Honourable Chief Justice of Nigeria, Honourable Justice Aloma Mariam Mukhtar, at its meeting which was held on 24th and 25th April, 2013 suspended Honourable Justice Abubakar Mahmud Talba of the FCT High Court from office for a period of 12 months without pay.
Honourable Justice Talba was suspended from office sequel to the findings by council that he did not exercise his discretion judicially and judiciously with regard to the sentences he passed on one of the accused persons, Mr. John Yakubu Yusuf, in the Police Pension case of FRN Vs Esai Dangabar and 5 Ors.

“It is recalled that the National Judicial Council at its emergency meeting which was held on 20th February, 2013 set up a fact-finding committee to investigate the allegations levelled against Honourable Justice Talba in the Police Pension case of FRN Vs Esai Dangabar and 5 Ors.

“The council however, observed that the charges that had been brought by the Economic and Financial Crimes Commission (EFCC) against Mr. John Y. Yusuf in the first charge sheet containing counts 1 to 10 under Section 315 of the Penal Code that provides a maximum jail term of 14 years and fine, were dropped by the EFCC counsel and substituted with another charge sheet with only three counts under Section 309 of the Penal Code that moulds a lesser punishment of two years imprisonment with or without option of fine.

“The National Judicial Council, in the exercise of its disciplinary powers under the 1999 Constitution of the Federal Republic of Nigeria as amended, also issues serious warning to Honourable Justice Talba to desist from unreasonable exercise of judicial discretion in all matters brought before him.

After taking bribe, they come to court and deliver outrageous judgement. These so called judges who mortgage their conscience will DEFINITELY stand before God and give account.

This country of ours is just a sham, an absolute joke. So suspending him for a year without pay is enough for someone (a judge) who does not understand the severity of a crime and passes a judgement which is definitely laughable. What a travesty, we have no clues as to how a country is run. We shall be stagnant for a few more decades to say the least.

He's generation will pay for letting a man that has caused and is still causing so much pain to our retired officers go Scot free. What manner of wickedness is this? Cos u want to be rich n covet all u can, u charge a man 750k, a man who's caused d untimely death of so many people. May God judge u. I cannot bless u,u are vile! as a child of God I Decree that because u have contended with innocent people, God will contend with u, a big hole shall be dug into ur pockets and u will never fathom what u spend ur money on. Justice Talba, was this public humiliation worth it? I'm sure you feel stupid right about now. Next time, use your head.

*Linda. How can we be sure that he will be fair in his future judgements after he returns from the suspension? He has been tainted and decisions he makes in the future will be suspect. This guy should have been sacked and put in jail to send a message to the other currupt civil servants.
This is not diff from Jonathan's pardon of Alams

What does that one mean self,no pay for only one year. He does not need that their rubbish salary self. If they stripped him of his title and that he is no longer a lawyer b4 any of them think of doing smthing funny he or she will tread carefully. Way if he was paid handsomely. Way is one or ten years pay to him but strip him of his honour gbam! OZ

You are a disgrace to the judicial system.

But the money paid the guy for that judgment can pay him for years...why suspend him for only a year? Njc just did what Talbe did!

One year penalty isn't enough. He should be de-robed too so that others can learn. He isn't worthy to be associated with such a noble profession.

Anonymous said...

Why did EFCC counsel reduce the charges though. At the end of the day, lawyers are liars

Anonymous said...

A good start, others will sit up and render good judgement

Anonymous said...

U are very correct. Even 2,999 sqr m was rejected. The judge shld av been tried and sentenced to 5yrs in prison without an option of fine. Big thief, how can he free a man dat ate pensioneer's money. Kai, I dey Vex o.

before u illiterates express your opinions, please read the fact of the case. the efcc had dropped the heavy charges and substituted it with a lesser one which carries lesser degree of punishment therefore, on that basis the judge exercised his discretion in the right manner and it is very wrong and unreasonable for him to be suspended.

Anonymous said...

This is too small for his crime, but God's punishment is what he can't escape
