Court grants PDP permission to declare Tambuwal's seat vacant

A Federal High court in Abuja today Dec. 1st gave PDP permission to apply for a mandatory order compelling either the Speaker or Deputy Speaker of the House of Representatives, to declare the Kebbe/Tambuwal seat being held by Hon Aminu Tambuwal vacant following his recent defection to APC from the PDP.

The PDP had dragged Tambuwal to court, asking the court to mandate him to declare his seat vacant and vacate his position as Speaker following his defect to the APC.


Delivering his ruling today, the presiding judge granted the PDP "leave to apply, by way of judicial review, for an order of mandamus compelling the Speaker or Deputy Speaker of the House of Representatives to give effect to the provisions of Section 68(1)(g) of the Constitution by declaring the Kebbe/Tambuwal federal Constituency seat vacant.”.

On what grounds.
A law they have trampled at a given stage of declaration. Due process shouldn't be considered only when the opposition defaults or haven't they heard "Leadership by example".
Tambuwal should concentrate on the governorship seat, he can't have it both ways.

Woooww Judgement so fast, its the judiciary has undergone some reform over night or the GEJ administration is pulling the all powerful executive strings. but we are watching in amazement how all this will play out. but technically the way these politics are been heated up. i nurse a deep sense of fear for this country.

What the Presiding Judge, Justice Ahmed Muhammed said was that he turned down the prayers of the PDP lawyer Chief Mike Ahamba to declare Tambuwal'a seat vacant through an exparte order of the court. The Judge only said Tambuwal should be put on notice regarding the exparte order request of the PDP. Please always seek the opinion of legal experts to interpret court statements for you if you don't understand before rushing to press and misinforming the world. THis is a volatile and charged political era.

One of our problems in this country is dat d judiciary, an arm of government do not have a mind of its own. Dey always play to d gallery of d presidency and until it develop a mind of its own and sees itsef as an arm of govt d status quo will remain while d masses will keep groaning. At deir incompetence. Mimiko of onto state decamped to PDP only recently and d court was not prevailed upon by the presidency for his seat to be declared vacant. To PDP n jonathan there is zero tolerance to the opposition.

The fg applied for leave to apply for judicial review and it was granted and u call that a brilliant judgment? Leave means permission to apply. The substantive application itself has not been heard or ruled upon. Lawyer indeed. Smh.

That's a very un-informed comment. A court of competent jurisdiction has already ruled that if a governor moves to another party, he remains the governor as the electorate are known to vote for personalities, not parties see the case of Theodore Orji in Abia state who won on the platform of PPA and moved to the PDP.

In the case of the Speaker of the House, the majority party in the house is supposed to produce the speaker. PDP is the majority party, if you leave the party, you can't remain the Speaker...it is that simple!
