Court orders 37 defected PDP House of Reps members to resign

The 37 PDP House of Representatives members who defected to APC in December 2013 have been ordered to vacate their seats and the House.
Justice Adeniyi Ademola of the Federal High Court in Abuja gave the order today while delivering judgment in a suit filed against the defected lawmakers by the PDP. The judge said the lawmakers no longer had any business, morally and legally in the Assembly and so should resign.
"Having perused the arguments of counsel and the constitutional provisions, it is clear and unambiguous that the defendants were sponsored by the PDP and won the election on its platform. It is also the court’s opinion that their tenure has not expired and there is no division in the PDP.
“The defendants are, therefore, not competent to vote or contribute to any proceedings in the House of Representatives. An order of perpetual injunction is, hereby, ordered, restraining them from altering or attempting to change the leadership of the House of Reps,” Justice Ademola said.
In January 2014, PDP instituted a suit against the defected lawmakers who attempted to cause an alteration in the leadership of the House of Representative.

Members have the right to defect, only if there's division within the party.
It is left for them to prove their case at the appeal/supreme court that such schism exist in the party.

Is that poSsible? Cos even though they were elected under the platform of PDP and are now defects, that shouldn't really affect their positions or does it?

What I see are two over-fed parents in a naked brawl while the house is gutted...btw, this is the kind of court case that receives a quick judgment in Nigeria. Otedola vs Farouk's case and many other like cases are sleeping comfortably in dark cupboards...

So, because pdp decided 2 take lawmakers dat defected from deir party 2 court and won d judgement, which is subject 2 appeal BTW, it prompts d comparison to y dere r pdp legislators in pdp dat defected from oda parties? Allow me to point out here that d courts are available for everybody. Nobody stopped other aggrieved parties from going to court as well. Stop taking Panadol for another person's headache. These ppl u r defending, on both sides of d divide, don't have ur best interest @ heart. Its jst sad when Nigerians think odawise despite d evidence available @ deir disposal.

Good judgement.They won because they contested under the PDP platform.Why didn't they contest under the platform of DNPP and see if people will vote for them.It was both morally and legally wrong to rob Peter to pay Paul.

Not plausible. So if you don't defect on paper, but you pledge allegiance to another party, attend their meetings and vote another party's agenda nko? The nature of Assembly representation promotes individuality based on the peculiarities of the constituency represented. So if your whole state structure trends one way, how can the court force you to support the opposite?

A political party is not a cult that requires initiation and lifelong membership. A man is free to associate with any party and dissociate as it pleases him/her. If a candidate has been VOTED into office then he is expected to RETAIN his position until his term/tenure expires REGARDLESS of current or future political affiliations. The judge is a product of OUR environment.He is either completely clueless or has received so large a bribe that he is willing to forfeit any ounce of credibility he has in order to satisfy his pay-masters !! Lots of politicians decamp in the U.S and this case wouldn't even make it to the docket of ANY court of law let alone be presided over by a any judge.
NO CRIME WAS COMMITTED so WHY is this even a LEGAL issue ?? Freedom of choice and the RIGHT to associate with ANY group. I believe those are some of our FUNDAMENTAL RIGHTS as HUMAN BEINGS !!

Very good judgement. For those of us who don't know, please look for a copy of the constitution (dem dey sell am for road).
Unfortunately, those Apga, CPC and AD legislators that crossed to PDP are not affected. Reason- the constitution states that if your party merged to form a new party your old party seizes to exist so therefore the court ruling doesn't affect them. Lol. It just goes to show that oga GEJ did his homework very very well.
Unfortunately for the affected lawmakers, a court of competent jurisdiction ruled last year that there was no division in PDP - the reason they claim for their decision to decamp.
ACN will hate themselves now, especially Rotimi Amaechi who was the person who set the precedence in the first place.
I laugh in Swahili... GEJ na real slow poison.

first things first..am not a fan of either PDP or APC (all of them want their share of the national cake)

Nice presidential move....after supporting them to win under the PDP platform, they think they can just move to another party and still occupy the assembly's seat??under who then? PDP suffer, APC reap the rewards??
hahahahahaha...good for them. let them come and join the jobless like us till 2015 when they can now compete under APC!!
