Appeal Court upholds Ibinabo Fiberesima's five year jail term

Let me start from the beginning so it's easy to understand. In 2005, actress and mother of three Ibinabo Fiberesima was involved in a vehicle accident on Lekki-Epe Expressway in Lagos that cost a man his life. She vied off her lane and hit the car of a doctor, Giwa Suraj, who was a staff of Lagos state hospital. Ibinabo was arrested for dangerous and reckless driving and charged to court.

The case went to court and the Igbosere magistrate court sentenced her to five years in prison with an option of N100k fine. Ibinabo apologized to the man's family, paid the N100k fine and thought the case was over but the Lagos state government objected to the fine and took the case to a high court...

The High Court then said that the Magistrate court was reckless when they gave Ibinabo an option of fine for such an offence. The High court judge tossed out the N100k option and sentenced Ibinabo to five years in prison, saying that such an offence - reckless and dangerous driving which causes another person's death is liable to 7 years in prison. Ibinabo's N100k was subsequently given back to her.


So she and her lawyers took the case to court of Appeal, asking the court of appeal, Lagos Division, to set aside the prison sentence and restore the sentence she received from the magistrate court (N100k) but unfortunately, at the judgement that took place today March 11th, the court upheld the high court ruling and dismissed Ibinabo's appeal, saying it lacked merit.

Ibinabo was in court today and reportedly wept when judgment was passed. She and her lawyers are now heading to the Supreme court to appeal. If they fail at the Supreme Court, the AGN president will be spending the next few years in prison.

  14. She didn't apologize to Dr Giwa's family at all! It was Daniel Wilson that went to apologize and beg the family because it was his jeep Ibinabo was driving that night. Vehicular manslaughter is 5-7yrs true, + DUI (reckless endangerment) is 11-15 in total. The judiciary system is lenient on her Abeg! She should be sentence at least 10yrs with no parole possibility. Cause she is not sober for killing Dr Giwa

I was just discussing this incident with a friend of mine last week as we discussed how some serious offenses get swept under the carpet prolly cos of the person's social status and the top shots she knows. She and her lawyers are devils, you kill someone and you want to just pay 100K and go. What about the deceased family? Do you know the deprivation they'd have faced, first from loss of fatherly love and then provision...and you want to pay 100K and be cruising around town like nothing happened. My fried, SERVE YOUR JAIL TERM!...Infact, her lawyer(s) should share the same prison room with her.

I pray Supreme Court will dismiss the case and give her a fine of 100million naira, because sending her to prision won't bring the man back, but the money can help the family of the deceased.

The N100,000 originally set by the magistrates court is too small to compensate the family, but no more an insult than the pitiful value the Nigerian government attaches to the life of Nigerians. Does the nigeria government spend more than N100,000 on any Nigerian? See N5000 to youths the FG refused to pay. Lagos State Government took up the case na lie.   135. Biko when you kill someone, it's not the deceased's family that sues. Get your facts right and stop being unnecessarily emotional. It is The People of Lagos State versus Ibinabo Fiiberesima. The deceased's family members do not have a say in the matter at all.

  137. Every court hierarchy has a maximum limit of fine it can impose. The case was held in a magistrate court (the lowest of all) so i am not too surprised 100k was the fine as at 2005.The question rily should be if the magistrate court had the power to conduct a case that involved death.

  138. From 100k to life case! Well, sometimes, we have no control over how it will change an when and with whom.

    I think she should have really begged the family and try to keep in touch. If she did that a the court still goes ahead to send her to five years imprisonment, then, we should look at what th law says for those who commit such offence.

I just hope this judgement is not due to Vindictive buhari trying to hit below the belt to get a cheap victory over Dame Patience Ebele Jonathan (my amiable firstlady aka Mama Peace) as she is of the same tribe as Ibinabo (Okrika).we need to forgive each other so that God can forgive us our trespasses.
