Saraki’s counsel faults Falana, Sagay over Supreme Court ruling

A counsel to the Senate President, Senator Bukola Saraki, Prince Ajibola Oluyede, has faulted the tirade of condemnation that trailed ruling of the Supreme Court over the trial of the senate president at the Code of Conduct Tribunal, stating that notions are clearly misconceived.
Making the disclosure through a statement titled, ‘The Supreme Court and the mob hysteria’, Oluyede, who made a particular reference to comments credited to Mr. Femi Falana (SAN) and Professor Itse Sagay (SAN), noted that the perception of the eminent lawyers on the ruling were wrong.

Falana was quoted to have said, “It is unfathomable that the Supreme Court decided to return the country to the status quo ante in a rather brazen and bizzare manner”, while Sagay in his opinion noted that, “what the Supreme Court has done is illegal and it is shocking that the Supreme Court would indulge in illegalities”.

According to Oluyede, “the orchestrated tirade against the Supreme Court of Nigeria in respect of daring to do the unthinkable by scuttling the politically motivated stampede to remove Bukola Saraki from his position as Senate President through a wholly unconstitutional trial at the Code of Conduct Tribunal is understandable.

“Both eminent lawyers are intolerably wrong and thus give the impression that their per incuriam opinions could only have been motivated by prejudice and not by their well known life long struggle for the public good.”

While noting that those raising the issue against the ruling of the apex court in respect of an issue which is still sub-judice, smacks criminal contempt, he added that it is erroneous for anyone to state that it is illegal to grant a stay of proceedings in criminal proceedings.

“If the Supreme Court perceives that the criminal proceedings against Senator Saraki might have been improperly instigated for any reason it is obliged to join in the fight against corruption by stopping it completely and to this end may properly stay proceedings until it is satisfied that its perception is wrong.”

 Lauding the fight against corruption in the country, Oluyede, however, noted that the idea to limit the power of the courts to grant stay of proceedings in criminal trials is not the appropriate way to root out the corruption in the judiciary, adding that the method must not be at the expense of the integrity of the institutions of democracy.

Falana and others faulted the ground on which the Supreme court suspended the trial pending the decision of the court of appeal, they found such judgement ridiculous.
And it's not out of place for them to show their reservations on the ruling.

How is the Supreme Court's judgement ridiculous pls? I totally agree with Saraki's counsel, the perceptions of Itse Sagay and Femi Falana are wrong, the notion is misconceived.

AJIBOLA OLUYEDE REFUSED TO QUOTE ANY LAW OR EVIDENCE TO JUSTIFY THE RULING OF THE SUPREME COURT OR WHY FALANA AND SAGAY ARE WRONG. I WEEP FOR THIS COUNTRY. THE JUDICIARY IS COMPLETELY IN A MESS. THE POOR ARE BEING PERSECUTED FOR COMMON CRIMES WHEREAS THE RICH ARE LET LOOSE ON MEDICAL GROUNDS TO RUN AWAY ABROAD TO ATTEND TO PERCEIVED SUDDEN MEDICAL AILMENT. Its just too obvious that Bukola Saraki is being picked on specifically to face the CCT because some very angry powerful people want him out of that position as the Senate president of the 8th senate. I don't care anymore if he actually has a case to answer at the CCT or not, the real reason behind his facing this trial is beyond appalling and that should make us, we as Nigerians weep for Nigeria more than if his trial at the CCT is suspended.Why should they (those that want him out, becos he is not their preferred choice) have any say in who becomes the senate president of the 8th senate? Are they the senators that have a right to vote for who they want to be their leader? Or is Saraki not from the ruling party APC? May God be with Saraki and see him it all. Amen

This is a beer parlour argument by Oluyede or whatever his name is. Falana, while backing his argument he quoted several laws including previous judgement on stay of proceeding in criminal case. But this criminal lawyer failed to quote a single law that back his argument, what a foolish man trying very hard to shield a criminal

How can the Supreme Court, in defiance of the Administration of Criminal Justice Act which prevents ALL courts from granting applications for stay of proceedings in criminal trials, grant stay of proceedings in the Saraki matter. The Supreme court no matter how eminent it is, cannot be above the law? The duty of ALL courts including the Supreme court is to enforce and interpret laws. Mr Oluyede never for once mentioned the fact that there is a law which prevents the Supreme court from doing exactly what it did. Neither did he also inform us of the law which empowers the Supreme court to act in breach of the law. His statement is nothing more than mere grandstanding and a sound bite to gratify his current and potential empoyers. Lets even assume that he is correct about the perceived persecution of his client, the way out of the perceived persecution is not by committing another wrongful act. That would rather compound the situation.

Falana and Sagay are obviously strong supporters of GMB ,falana was almost a minister ,but for last minute shake up that saw him loose out ,while Sagay has been compensated for support to GMB during the elections as a panel of inquiry member with full . They are also hoping for juicy legal briefs and consultancy jobs ,hence their agitations. The duo and all haters of omo Oloye should deal with the bitter truth that Saraki has come to stay as Senate President till 2019. By the way ,Falana is also hoping to get GMB's nod for Ekiti Governorship election after Ayo Fayose's tenure
