Uduaghan pardons 24yr old student sentenced to death by hanging for stealing phones

Delta state governor, Emmanuel Uduaghan has granted total pardon to 24 year old student, Moses Akatugba who was in November 2013 sentenced by an Asaba High Court to death by hanging for stealing three mobile phones and recharge cards (read here).

Moses was charged to court after he and his robbery gang robbed a women of about N100k, phones, and recharge cards valued at over N100,000 in Delta state.

He was apprehended at the scene of the incident while other members of the gang escaped. After the verdict was handed by the presiding judge, the international community and local social crusaders launched a massive campaign for a state pardon for Solomon.

This wish was granted as Governor Uduaghan during his last Executive meeting at the government house, Asaba today, 28th May. Not only did he grant Moses total pardon, he also commuted the death sentences of three others to various terms of imprisonment.

    3. The punishment for Armed Robbery under the Robbery and Fire Arms Act is Death regardless of what was stolen. The punishment is mandatory and the Judge doesn't have the discretion to pass a lower sentence. Blame the law,not the Judge.

    1. Actually, it's death by hanging for armed robbery. What amnesty international failed to mention is that they used guns and also beat up the woman.

      Imagine if you were in your office jeje and armed robbers come with their guns and beat you up and steal all your salary and everyone's salary. Is it okay?

  39. What a country!!!! A boy steals three phones, one hundred thousand naira. He gets a death sentence. Politicians steal billions in that same society and nobody jails them. That judge will get a sentence worse than death by hanging. A society where politicians forage on the country's resources with impunity. This is how bad a mere geografical location (nigeria) is.

  42. THE LAW IS AN ASS AS THEY SAY, IT'S NOT WHAT YOU STOLE BUT HOW. DISPOSSESSING ANYONE'S BELONGING WHILST ARMED WITH A DANGEROUS WEAPON IS PUNISHABLE BY DEATH. IT DOES NOT MATTER WHETHER A POLICE I.G. STOLE N17.5B OR NOT. ANY LIFE THREATENING ACTION TAKEN BY A ROBBER AGAINST HIS/HER VICTIM COULD ATTRACT DEATH PENALTY.

Correction: dispossesing any1 while armed is armed robbery and cud be punishable by death, however, the conduct during the crime and other extenuating situations(criminal history of assailant) may be considered-room 4 interpretation and delivery rests wit da Judge. But even so, 4 a case like dis the ;udge went all-out, one can only assume dat the young man had NO legal representation in court.

The sentence for that is a minimum of 15years to death, I pray u don't experience things with these armed robbers. I hv no pity for them at all. The fact that he was caught stealing fones with guns does not mean they hv not been killing their other victims. I support life sentence for those thieves.

  50. Most of the readers of LIB display shocking ignorance, which is indicative of the level of ignorance in our society. Whether an armed robber steals ten kobo or chewing gum, śo long as he used offensive weapon or firearms to commit the crime, his mandatory punishment is death by hanging. You open your dirty smelly ígnorant mouths to abuse a judge dutifully doing his job according to law. And you too, Linda Ikeji, for misleading your gullible readers instead of doing proper research to know the true facts of the case and what the law says, you are doing a disservice to the public. I know gutter journalism puts bread on your table' but don't you feel guilty inducing ignorant people to malign others and thus commit sin against God? Remember that the bible says though offenses will come, woe unto him (her), through whom it comes. You are causing people to stumble by deliberate misinformation, or cheer laziness, and I hope you know you will share in their punishment if God decides to punish them for cursing innocent people for doing their job the right way.
    I don't know this judge, but I know he was right, and you and your readers would have caused him and his family terrible pain by your stupid uninformed comments. By nature of his job the judge can't reply añd must suffer in silence. But what you and your stupid readers don't know if that God defends such people . I really pity you.
