Supreme Court upholds Fayose's election, dismisses APC's petition

The Supreme Court has upheld the election of Governor Ayo Fayose of Ekiti state and dismissed the petition against him. At a ruling this morning April 13th, a 7-man panel led by Justice John Fabiyi dismissed all the grounds of appeal filed by the petitioner, APC members in the state House of Assembly, who argued that Governor Fayose was not eligible to contest following his impeachment from office during his first administration.

Delivering judgement, the court held that while impeachment was not a ground of disqualification ‎from contesting as governor, the panel which recommended Fayose for impeachment on October 16, 2006, was illegally and unconstitutionally constituted.


The court also ruled that allegations of certificate forgery is not substantive as the HND certificate Fayose presented when he signified interest to run for Governor was genuinely earned and was awarded to him. Regarding allegations of the use of the military by Fayose to intimidate APC supporters during the June 2014 governorship election, the Supreme Court ruled that the Chief of Defence Staff and the Inspector-General of Police, joined as 4th and 5th defendants in the case were not necessary parties.

  7. I am super elated at this news, because I now know Nigeria is really a democratic nation. I know he has a loose tongue but he was voted in by his people and whatever he says shouldn't be a basis to impeach him. I actually thought APC will use their power to remove him. Congratulations to him and to our nation Nigeria.

  56. With the Ekiti gate recording which is an overwhelming evidence, the supreme court still ruled in favour of this criminal. Anyway, Nigerian justice system is cash and carry. All these corrupt judicial officials have to be shown their way out by the incoming administration. Enough of all these justice on sale.
    This ruling might appeal to PDP supporters, who would even support the devil just to spite the APC, or dismiss an honest opinion by cheaply blackmailing it as hate. Truth is coming into Nigeria, sooner than later and those politicians associated to falsehood , corruption and impunity will be relegated if not extinct from our polity.Watch out!

Reading through lines of commentaries on social media (LIB inclusive) and seeing the dubious felicitations that greeted the dubious ruling of our supposedly supreme court today on Fayose's case leaves one to only understand the reason why corruption and impunity has continued to reign supreme in this country. Our justice system is nothing but cash and carry, or best offer to the highest bidder. No wonder it's hard to find anyone example of the high and mighty particularly those linked to the ruling class ever brought to justice in this country irrespective of any impeccable evidence available for all to see. It had to take foreign countries to bring erring Nigerian elites and politicians to justice, otherwise people like Alameseigha and Ibori who are celebrated by crowds as king would never have seen the four walls of a prison yard. It's just a pity and so sad a situation. On the other hand , the masses many of whom are rented by these crooks are not helping matters, they sell their conscience even knowing they'll end up being the downtrodden. Some times I wonder what level of poverty would make a people behave as if they're bewitched by preferring to eat their tomorrow today and sing praises of their slave drivers.
    Another very disturbing phenomenon in Nigeria today is the bastardization in the use of the name of God. Politicians deceive U in the name of God, fraudsters dupe U in the name of God, after many vices are committed criminals would 'give God the glory', after politicians massively rig elections and connive with the courts to thwart justice they still 'give God the glory'. No wonder Nigeria is so littered with all manner of churches, yet evil grows at exponential rate in the land. Where are we going with all these? Have we not seen in the scriptures that God is not mocked? And that whatsoever a man sows that is what he shall reap? We are the architects of our fortunes , good or bad, and unless we change and turn from self delusion and falsehood, everything would always seem to work against us as a nation. Good governance may continue to elude us because our leader come from the populace, not from space. Please let's all consider again, for righteousness exalts a nation but sin is a reproach to any people.
