Read her story below
My name is Uche. I am a hardworking 32 year old female entrepreneur and I consider myself quite successful at what I do. I live in a 2 bedroom house in Surulere, rented, renovated and furnished by me without the help of any one. In fact when I moved into my house, it was in a terrible state and so I used my hard earned money to fix the house because the landlord refused to do it.
It was not a problem for me because I felt I would be able to fix to my own specifications. The premises also houses 4 more flats, although I was lucky to get the detached mini - duplex in the back and nobody's rent is below N1m.
Fast forward 6 months after moving
into my home,I got bladder infection which I treated and after that I
wanted to buy a water-pumping machine and a water tank for my personal
use, because the central tank used has lots of dirt in it and brings out
brownish water.
When I went to get consent from my landlord (who also
conveniently lives in the same compound), he told me to give him the
money so he can use in drilling a borehole because what we presently use
is government water. When he kept insisting, I refused. He told me it
was selfish of me to think only about myself and he would make me suffer
and forbade me from buying a tank or pumping machine. Being that I am
only a tenant who didn’t want to make or cause trouble, I let the matter
go and continued to use the water provided by the landlord, which is
pumped and circulated only at his convenience. I continued to be a good
and peaceful tenant, even gifting my landlord a phone for Christmas and
giving his wife and kids some clothes as well.
A
short time after that, the fuel crisis began. I was lucky enough to
have made friends with the manager of one of the gas stations nearby and
because of this; I was able to help the other tenants buy petrol…in
fact it got to a point where I was collecting everyone’s jerrycans,
including that of my landlord to buy fuel for them. However, it was here
that things began to take a sour turn.
The
other tenants and I began to notice that our petrol would mysteriously
always go missing. It was very strange and we naturally assumed it was
the security guard stealing from us. When we took the matter to our
landlord, he neither said nor did anything, which is quite unusual
because he normally would take action on such a matter. At this point,
we decided to take matters into our own hands by writing our names on
our respective jerrycans and buying a padlock and key for the storage
space for the petrol and gave it to the security man. We told him to
always lock the storage and not give access to anyone. Nobody would be
able to get fuel without him unlocking the place. Yet the fuel still
kept getting missing. I realised that my landlord always bought not more
than ₦1,000 (One Thousand Naira Only) worth of petrol at a time, and
the last time I helped him buy fuel was 3weeks ago, but he would run his
generator every single day. I thought nothing of it until the thing
that happened next.
As fate would have it, I
had bought a jerrycan of petrol for one of the tenants, who is a
director in one of the federal government agencies the day before The
following afternoon, I was on my way out of the house when I perceived
the smell of fuel. Further investigation revealed that the storage room
was open and my neighbour’s jerry can was open. By the time I got
outside, lo and behold, I caught the security man pouring petrol into my
landlord’s car. To say I was shocked was an understatement, but I
didn’t say a word, instead I got into my car and drove off. From there I
called my neighbour and told him what I saw and asked him to check his
fuel when he got home.
When my neighbour got
home, the security guard opened the storage room for him and an
inspection revealed that more than half of the petrol in the jerrycan
had been stolen. The security guard claimed it leaked but there was no
trace of leakage. Next thing the landlord appeared, ready for a fight,
and asked him why he chose that day to check his fuel and not the day
before. The next thing the poor man knew was that the landlord gave him
two slaps and started to hurl insults at him and said he is giving him
7days to pack out of his house. PS: his tenancy expires May 2017. He
also called the man’s wife on the spot (who coincidentally is my friend)
and told her that I am sleeping with her husband. The man tried to walk
away and my landlord followed him even into his flat insulting him.
I got back home some few minutes after 9pm,
met another of my neighbour who happens to be a manager in a new
generation bank(PS: she has also been physically assaulted by my
landlord in the past) while exchanging pleasantries she began to tell me
about the fight. My landlord appeared, pulled my shirt, slapped me and
started beating me. My neighbour ran outside the gate and started
calling for help. It took the intervention of people to save me from his
grip.
I still have an existing tenancy and i'm here wondering if I should give up my rent and go look for another house.
When
I moved in my landlord collected 2yr rent plus service charge and till
date hasn't given me or any of my neighbours receipt or agreement to
sign. He usually gets feisty anytime we ask for it. My neighbours and I
are living in bondage. He has done a lot of intimidating things to me,
ranging from asking the security man to knock on my door and walk my
guest out. Not once or twice has he done this. He says he wont have
anyone he has fallen out with in the past enter his compound and doesn't
care who the person is. Sometime back, he locked the control that
supplies water to my flat simply because I complained the water was
dirty, had a foul odour and suggested to him to make arrangements for us
to wash the tank.
Linda I am sad,depressed
and confused and would appreciate advice on how to handle these issues.
Are there no laws governing landlords? Aren't tenants entitled to some
rights? Please and please I'll greatly appreciate if anyone out there
has information on the relevant authorities that can help me sort out
these issues. Please find attached pictures of my apartment. I spent
money to make it comfortable and the thought of abandoning it is
heartbreaking especially with the current economic situation.

As far as I am concerned, this is a very stupid complaint/write up. From what you said, you sound learned and financially comfortable. Don't you know the way to police? Can't you get a lawyer? As in this complaint is more than just stupid. You just wanted attention and to show us u have a beautiful home.. DeleteFirst of all, ur house is lovely. N beautiful. I understand what u re going thru... some of this surulere landlords steals n still form like they aint like dat. Had similar experience dere. My advice to u is dat, do not quit cos dat is his plan, he want to frustrate u den increase d rent for another incoming tenant. Mind ur own business in dat house. One mistake we usually make is being too friendly n close to some lagos landlord by buying gifts for them. Sometimes when u stop buying, u become a bad person. So never start what u cannot finish. Respect ur landlord by making sure u greet him well. Ensure u update ur rent n any other important payment n mind how u relate with neighbours. Be friendly to them but not gossiping with them. Then if d case continues, u can report to the police about it. Take care

DeleteMy parents are landlords and the tenants are devils. Its a long story but we were once tenants too. Report him to the police and get a good lawyer that knows his onions. Deal with him plain and simple.

ReplyDeleteI commiserate with you on your sad predicament at the hands of such a lawless landlord but I think you need to take sensible, wise and systematic steps to right this wrong. The landlord needs to be put on his place unless he will continue to live off the tenants and continue this in humane treatment, for him to have a habit of assaulting his tenants even women at that, you need to report it.
ReplyDeletePlease make peace with the fact that you may have to get a new place sometime along the line... But till then, 1. get a lawyer 2. Get sound advice and begin to start documenting and compiling evidence against this landlord. I hope you kept all your receipts for home improvement. Everything you paid to improve the house please keep it. Make only bank transfers to pay rent to the landlord. Take pictures of the physical assault on your person. Bruising etc and with a lawyer report it to the police so it's documented. 3.You should commence action in a rent court when you have sufficient evidence against this landlord but please look for a lawyer asap.

DeleteI've read your story and in matters like this, one needs to be objective and not sentimental. You are living in the house you've paid for. If your landlord wants you to leave, he will need to give you a quit notice. A quit notices 6 months. If you paid the rent through your bank or cheque, that itself confirms payment and the fact that you've been living there, proves that you had consent to live there. You do not need to have a rent agreement to prove you are a tenant.
ReplyDeleteYou need to get yourself a lawyer as your landlord will need to refund your money for any months you have bot used if he insists you leave his property. Be polite and ensure all communication is writen and NOT VERBAL.
I don't understand why you are writing essay instead of taking action. Get a lawyer, get the police involved, get another house meanwhile as you prepare to fight him cos he would never let u have peace.

Lagos state has a very strong tenant protection law enacted by the then governor,fashola. You guys probably didn't know. No tenant is suppose to pay more than a year's tenancy fee. You guys have to charge the rascal to court, the court will put him where he belongs. He probably is a retired military or police man. Don't be afraid, take the case up.

How on earth do you pay that kind of rent and service charge without signing any form of agreement? your rights should be stated in that document and since you dont have it there isnt really much you can do on your right as a yearly tenant.

If so, you can go and report him for the assult and get the police involved if not u might not live to tell the tale the next time. You can also report him to the citizen's mediation center around you. He will invited and the matter might be reolved.

Get touts to harrass him, or gather your fellow tenants and bring a joint action against him.
If you are going to leave, atleast leave with some compensation. He breached his duties as a landlord. You need the tenancy agreement though. Don't understand why Nigerians play with paper work

forget any tenancy laws my dear, in as much as you can afford such rent, am sure you can get the services of a lawyer.. even if you cant, why cant you report the matter to the police, file for assault and attempted murder plus defamation of character.. its so simple... he will beg you to pay you the value of 20years rents he collects and must surely go to prison for such act.... u and ur co tenants amaze me wallahi

Sorry for ur misfortune. From what I read I deduced that you are educated and financially OK if not rich. So I assume you will have a lawyer or a legal representative, and if u don't, get one and tell him or her u wanna take legal actions. Am sure your lawyer will know what to do...

ReplyDeleteDon't just give up like that, get a lawyer and involve the police, even involve a top military officer if you know any. Also let the Landlords Association of the Area (if any exists) be aware
In addition, write a petition to the DPO of your area and emphasise that you fear your life is in danger due to the desperate acts of your Landlord. Let them make him sign an undertaking to cease all molestation against you.
Eventually, you would have to leave the place but you should leave at the expiration of your tenancy, but as long as your tenancy has not expired you should fight to be treated with dignity and without intimidation or molestation.
There are many landlords like that in Lagos who collect 2 years rent from desperate tenants but after collecting the money, they will frustrate the tenant to leave before the expiration of the two years so that they can collect another 2 years rent from another gullible tenant.

Before you know it, we would hear someone has been attacked with machete or beaten black and blue. Please report oppressive cases like this to the police even if somewhere in our minds we think they would not do anything about it. Report to about 2 - 3 different police stations. I would also advise to move out before it becomes more serious. Material stuffs cannot be compared to ones safety and life.

Wow! this is the kind of landlord I have waited all my life to see and am still looking for one. I go so deal with him that he will be the one going to police or court and will be begging me to pack out. Well, my advice is to calculate properly and provide the documented evidence of all expenditures, report the case to police to be aware and get a lawyer and sue his damn ass. It is an offence for a landlord to collect more than one year and its even an offence for you to pay more than a year according to Lagos property law. But again, you dont have evidence to show that you paid for 2 years, the foolish man can as well claim that your rent will be expiring next month. Next time get documents signed and filed

ReplyDeleteI rented a room self contain and buit it with my money to a room and palor.a year later I was building my own house which was about 90% to completion and because my landlord knew about it he gave me quick notice because it was January and I still had 6months to stay. I jeje parked and enter my house and complete it from there. My dear, you don't need to fight him. And mind you u can never please your landlord except they are extral ordinary nice. At the same times you can't tell what previous tenants must have done to your landlord that made him act that way. I have tenants in one of my house that for them to pay self I beg them. I have changed lawyer three times for that apartment yet no positive result. So tomorrow now if I decide to change new tenants will see me as a bad landlord.

ReplyDeleteMy advice is, don't go to police or anywhere, live your life quietly while looking for another apartment or where to build yours,then move out. It's not only yoruba landlords,its everywhere. It happened to me, we are supposed to be friends, I paid for one year and with no receipt and renovated the place. After one year she told me to move out that she needs the apartment and gace me just two weeks. I was mad and i knew it's jealousy and I left within the period.she is a born again without a sin, no permed hair, no make up, dresses like an evil woman. In fact let me not say everything, they are dangerous. So beware of them.

ReplyDeleteI know the Landlord very well, i know the house you are talking about, its at Ekololu Street, i supposed to be the one to rent the apartment your neighbor is staying in, i was at the house around November 2015, the man is so greedy the way he talks to me, am a bachelor and i dont like to live in an apt where the landlord lives, please stay in that house because he is looking for ways to send you guys packing then he can increase the rent and collect a new agency and legal payment.
Mind you, the gateman and the landlord are all family, he is there to monitor you guys.

DeletePoster, this is my take, and it's from experience. If you have no documented evidence to prove your rent remittance to him, it means you have no case. In fact, you'd be at his mercy. But if you do, seek for legal assistance. Ask your friends to make you a referral because despite your obvious good education and exposure, it seems you are not too conversant with the law. You need a referral from your friends, so you don't end up with a lawyer that will take you to the cleaners! A good lawyer will tell you the steps to take in resolving your rent issue and also the physical assault angle. If it were in Abuja, I would have personally intervened. Best of luck.

ReplyDeleteHi, you should seek mediation between both parties i.e., yourself and him. There are several landlord and tenant conflict resolution centers in Lagos.
ReplyDeleteUnfortunately, since there is currently no form of agreement between you and him, not even a receipt of payment as well for you to build a case, I would advise you do not fall prey to the Lawyers as they will also complicate matters.
Seek counsel/mediation through Lagos state, there is a unit that handles this, just inquire some more.

Report to House tribunal in Alausa. Most times the cases are always in favour of the tenants. They'll call him to order. Gather all ur documentation cos they'll need it. They'll serve him a notice to appear b4 the tribunal and make him compensate u sef.

If a landlord is already proving difficult from the on set then that's a no no. Second of all I get you are a nice person but there was no need to develop that kind of relationship. In my apartment building I don't even have the relationship with my landlord when we see we greet but that's it. I pay my rent on time and keep my distance and because of that he knows not to mess with me. He can't even try it because I don't even give him room for that.

Prepare and submit a petition at the nearest police station of his assault on your person and get a lawyer ASAP. You would need to make a statement/ file a report as his actions have both criminal and civil implication.

Furthermore, the Lagos Tenancy law accords tenants with inherent rights...e.g right to enjoy peaceful possession and live in tenant-able conditions. I understand your dilemma and and have handled a few cases of this sort. Some persons have no appreciation for the commons man's fundamental rights, however the ability to bend their misconstrued will lies solely on your willingness to seek judicial redress.

If what you wrote is true, then you are not safe. Please report this matter to the police and get some protection. I would also recommend, you move out. No need taking chances.
