When the security men at P-Square's home refused them entry, saying the brothers were not home, they allegedly forced their way in injuring one security guard. (that's the injured guard above) And here's why they came for the brothers...
Many years ago...about 8/9 years ago, there was a show in Benin that they were supposed to perform in. According to a source who spoke with LIB, after they were paid N1million, the brothers arrived Benin for the show only to be told that the show had been postponed till the next day. P-Square refused to stay till the next day and returned to Lagos. The organizer of the show demanded for his money back and when he didn't get it, took the case to court. He got a court judgement and promptly moved to Lagos.
The source said the case had been in court all this while but the brother's weren't really aware of it as no one represented them. It looks like judgement may have been passed in absentia, which brought the court Sheriffs to their home today. They tried to tow a vehicle after showing the papers brought from the court but no one would allow them take any car away. The court Sheriffs are still in the house

DeleteThey can only denied not being served a court summon but truth is before a case goes on in court, the defendants are served. Absence during the courts process after being served leads to judgement in favour of the party present in court. So when you are served ensure you appear in court to defend the suit brought against you to avoid judgement levelled against you.

na wa oh! psquare again? how would a court offer such judgement. business is business. a service paid for, but not used is a lost service. service is intangible. if u pay for a hotel room and did not use it. your money is gone. u book a flight and didn't fly, ur money is non-refundable. unless there is an agreement btw the two parties. the organizers should have known this. they would have offered extra cash for them to stay till the next day since they shifted the show. is not like the psquare didnt show up. this is bad naa.

A date was fixed for a show and the organizer postponed without letting them know as per the published news, they got to the venue and noticed it has been postponed, why will they not go back? if you are commenting based on the post on LIB, please read with understanding before commenting otherwise reference the post before writing.
ReplyDelete@Onyx Godwin, a case can very well go on if there is no representation for the Defence if it is not a capital offence. The Court will not go on with the case if there is no proof of service of the court process on the Defendant. If a Complainant/Plaintiff is unable to serve the Defendant personally, he brings a motion for substituted service which is mostly but not limited to pasting the court process/Order at the last know address of the Defendant (other means include newspaper publication and the like). When the court process is pasted as such, a photograph of it will be taken and that is what will be in the court file as proof of service and with that, the matter can conveniently go on from start to finish regardless of legal representation for the Defence. Infact, the Plaintiff/Complainant will keep reiterating that the Defendant has been served and he is in default of appearance (which in itself is contempt of court) and ask the court to rule in his favor and against the Defendant, which is 99.999 percent what must have happened in this case.
ReplyDeleteOn the other hand, if it is a capital offence that has to do with death penalty, the court will never ever hear/entertain the matter unless and until the accused is represented and if he has no means to secure the services of a lawyer, the state in most cases provide one for him because human life is involved.
Regarding the issue on ground and based on the one - sided story we were told, it will be very wrong for them to sue owing to the fact that they postponed the event after the arrival of the duo. What if they had another engagement elsewhere the next day and of course cannot possibly cancel due to the inadvertence of the organizers. We all know they are well sought after and may have engagements lined up for them just for one to cancel and expect them to disrupt their other engagements to what end? Anyway, let's just wish them the best in their trying times and pray God sees them through in Jesus Name. Amen.
If that is the true story then the court sheriffs should be labeled as criminals! why? the agreement must have stated that the performance would be at a specified date and venue which they showed up for all ready and geared to go. But, without any prior notification the show was postponed. Now did the brothers receive money for the event? Yes! Did the brothers show up for the event? Yes! Did the brothers honour the agreement? Yes! (there must have been a signed agreement). Did the organizer default on the agreement? Yes! Did he plan a two day event for P-Square? No! Does he have any right to hold P-Square liable? No! Look here, and listen good, you silly organizer who just came out event school, if you want to do things officially make sure any event you plan takes place on the "AGREED DATE!" For goodness sakes, P-Square honoured the agreement but the silly event planner/ organizer dishonoured it. Now to those bloody nonsensically imbeciled sheriffs, did the brothers commit any criminal offence? No! We're the brothers aware of the court's order? No! Has this matter even gone to court? No! What the heck! That schmuck who went and got the court order/sheriffs should be locked behind bars! If you want to do things the official way do so! and not pay some hungry court urchins =N=50,000 to do an illegal thing. My goodness you were told the brothers weren't t home yet the crippled hungry starving urchins physically assaulted and injured the security personnel assigned the task of securing the home of P-Square, what if the guard had died would that 1 bloody million naira mean anything anymore? ReplyDeleteBesides, when they sued the duo i am sure they didn't just sue for the One Million Naira. They will have other special damages, general damages (cost of litigation, etc), interest on the money from the day it was paid to the duo until the day judgment was given and so on. So at the end of the day, they will be asking for millions of Naira in their claim which might have been granted by the court. That is the way it works for all those saying One Million Naira is too small to sue the duo for. I think the best option would have been to nip it in the bud before it came to this. Best of luck to all the parties involved.

Haba, if they were sued, the should have received notification through their lawyers. The judiciary may be wack but it is not that bad that a summon won't be served a defendant. I am sure the brothers refused to do their own bit. What is a million to them? In this case they would have clearly taken out their expenses and paid the balance to the organiser of the show.
