I heard it is true, in Saudi, a woman can be jailed for reporting rape without providing at least 2 or 3 witnesses and the man being accused must admit it too, otherwise; the woman would be sentenced or get lashes of cane like this one. How barbaric? How many rapists call people to come and witness when they plan on attacking a woman? And how many of them would admit to it? So women will just be getting raped anyhow everyday; and if one happens to be married and also get pregnant as a result, she could be stoned to death for infidelity if sharia law is applied. No. You're wrong. If one accuses another person/persons of adultery and can't provide four witnesses then the accuser shall be given 80 lashes. For rape, if there are no witnesses, both shall swear an oath on themselves, and place a curse on himself or herself, and then they're left to go.
The wisdom behind the first case is that Islam forbids suspicion. The wisdom behind the second is that, since witnesses cannot be provided then the matter shall be left to God. From Islamic history, such matters that were left to God, the culprit usually got punished almost immediately.
It's true, in the islamic countries, once u are raped the both parties are jailed but more sentences goes to the guys and u are free once you can provide 3 witness u were raped. Yes, it's part of their law. She probably reported the rape. Their law says she must have four men or eight women (one man equals two women) who must testify to having seen the act. And the law specified they witnesses must testify to seeing the penetration. Even if they see her clothes being torn or she's being hit and etc, they must have seen penetration before their testimonies will be accepted. This is practically impossible. Now even of they were seven women that saw the rape, the law won't accept it. They must be eight. I'd not the victim will be considered a liar and punishes with 80 strokes of the cane. So if she didn't have all of this she will be caned. No one really bothers with the rapist unless he confesses or she has the complete witnesses. This is the sharia law that I was taught in school and I wrote exam on.

i know it seems strange, but its what works for them, not every nation can implement America's definition of RAPE, besides have you gone to jail to see how many innocent men are incarcerated for RAPE? ReplyDeleteYes, it's part of their law. She probably reported the rape. Their law says she must have four men or eight women (one man equals two women) who must testify to having seen the act. And the law specified they witnesses must testify to seeing the penetration. Even if they see her clothes being torn or she's being hit and etc, they must have seen penetration before their testimonies will be accepted. This is practically impossible. Now even of they were seven women that saw the rape, the law won't accept it. They must be eight. I'd not the victim will be considered a liar and punishes with 80 strokes of the cane. So if she didn't have all of this she will be caned. No one really bothers with the rapist unless he confesses or she has the complete witnesses. This is the sharia law that I was taught in school and I wrote exam on.
