Police drops murder charge against banker, Yinka Johnson

Yinka Johnson, the banker accused of crushing a LASTMA official to death on Friday August 10th has been freed of the murder charge. The police, some LASTMA officials, eye witnesses and some members of the press visited the scene of the incident yesterday Monday August 13th to investigate further and afterwards all agreed that Yinka's car was not the car that hit and killed 33 year old Hammed Balogun. Eye-witnesses, including the one inside the bus that allegedly killed hammed, gave the police a clear account of what really happened that Friday.

After the investigation yesterday, the police officially dropped the murder charge and instead arraigned her for driving recklessly.

Yinka Johnson was brought to the Igbosere Magistrate Court today to face a one-count charge of driving recklessly. She was granted bail and ordered to pay fine. The case was adjourned to Sept 3rd.

  67. Let me burst some bubbles here. This woman is getting away with a crime. There is such an offence on our statute books called MANSLAUGHTER. The mere fact that she was on that road, driving against traffic, means that by implication, her action placed that LASMA official in the position where he could be hit and killed by another vehicle. Her action was the Actus reus of the death. But because the middle classes whipped up sentiments about LASMA recklessness, her 2 month old baby and being a banker, she has been let off lightly. This in the same country where a magistrate sentenced a man to 9 months in jail for stealing bread to eat. Classic case of the rich are not poor.

    5. Thanks a lot dude. You just hit the nail on the head.
People seem to not think at all. This woman through her stubborn attitude coulda exposed the lastma official to great danger and unfortunately caused his eventual death in this case.
      She should still be charged.
Let's assume she drove recklessly, thereby putting the lastma official at risk of been hit by another lawless driver like her - In this case, the bus driver as told us.
I wonder what all these people would say if they were the wife, son/daughter, brother or sister, parents of this late man.
We are all the bulk of the Nigerian problem. We start to praise the police for a good job done. They should be praised only if they parade the bus driver that hit and killed the man going about his official duty and also after arraigning this irresponsible mother of "two month old baby" for the right and appropriate offence.

      Delete
    6. Shownoja&bobo are u sensible at all! How did she cause the death of someone that was on phone while crossing the road? May the guy soul rest in peace but the only crime the woman committed is traffic offence! The people to be blame here are the LASTMA that let the danfo escape bcos they were busy with the woman instead of tolling d danfo and hv the driver arrested!!! Y didn't they take the woman's plate no and focus their attention on d danfo driver and their dying colleague! People shld think before they talk the only person guilty of manslaughter here is the danfo driver!!!

  72. @ Shownoja August 14, 2012 8:03 PM

Thank you very much for being enlightened. You read my mind. I suspect you're in the legal profession or read law. I agree with your comment. From a point of law, Yinka Johnson somehow contributed to the death of the departed. If she hadn't driven against traffic, the man that got knocked down by her or another motorist would be alive today. Her lawlessness created the scene in which the accident occurred. She should face manslaughter charge and jailed for at least 12 years. Other people are mindlessly and ignorantly commenting and exonerating Yinka Johnson. The facts of the case should be tabled before a court of law, and not the fraudulent discharged she'd been granted by the corrupt and shameless Nigerian police and prosecution service. The fact Yinka Johnson was set free don't mean she didn't do anything wrong. I suspect she, her employer and associates bribed and pressured the police and prosecution to drop the murder / manslaughter charges. There's simply no justice for ordinary people within Nigerian's legal system. This case stinks of corruption and injustice. It goes to show that with money and the right connection, a murderer can buy their way out of prison. I speak truths, without fear or favor. It is my believe and opinion that Yinka Johnson bought her way out of jail. What goes around, comes around. Evil returns with evil; good returns with good: every act done, no matter how small or big, always returns to the doer with equal impact. Remember that, Yinka Johnson.

Seriously I think the Lagos state govt should train their staffs well, u shud neva put urself @ risk of being knocked down by a moving vehicle, stop standing in front of them, well I suppose with the way naija is that's their way, I remember wen I was in school in the uk doing my nursing we were told we must always think about ourselves 1st, safety is paramount, don't try to be the hero, dis shud be an eye opener for Lagos state, or more of their officials will definitely lose their lives if they continue wiv dis acts

    2. Kemikal did u actually read law? How did she contributed to d guys death the main point here is that LASTMA shld train there workers very well or if am stopped for a normal routine at Check point and one of the officers was crossing d road while on phone and got hit, does that mean I contribute to him getting hit!! The guy was on fone when crossing the road so the woman did not in anyway hv anything to do with his death the only crime she committed is violating the traffic law! I don't know the woman but just sit and think about it or google manslaughter(homicide without malice aforethought)!!!

      Delete
    3. Kemikal if the woman is being chased by LASTMA for refusing to stop and the guy got hit in the process then she can be charge with manslaughte bcos she indirectly caused the guy being hit but she stopped and was even out of her jeep! Don't get me wrong am human and I feel sorry for the family and I also pray that the guys soul rest in peace but the woman doesn't hv anything to do with the guys death in this case she is even suppose to be a witness

  74. Hi Shownoja, the existence of manslaughter in the statutes will not change her flagrant traffic violation into vehicular homicide, haba! So according to your ethics of prosecution, it is proper to frame the accused with any convenient charge in other to obtain a manslaughter conviction. Hmm!! interesting.
May God save us from the all knowing internet lawyers.

  75. At the end of the day. it was her fault this man was killed. She was driving on the wrong side of the road ans should be charged for manslaughter.@ Anonymous 8:42 PM, I hope one of your relatives would not find themselves in a situation, where the person that ultimately caused their death would be allowed to go free. She should be charged for involuntary manslaughter @ least. I hope this also serves as a deterrent to LASTMA officials, your life is much more important than you chasing moving vehicle.Yes you are doing your job but @ the end of the day, you could end up dead!!

  97. This will teach them a lesson!

LASTMA also causes death of many people in Lagos.Remember the conductor and the trailer that was driven by them that killed people?

I don't pity them one bit because those that kill by the sword, shall also die by the sword!Their hands are tinted with the blood of the innocent!

Yes, money exchanged hands to buy her freedom. This is NIGERIA, deal with it!

This should be a lesson to the IDIOTS called LASTMA!

Until you have a taste of their wickedness, then you won't pity them at all!

More will continue to die until they learn to STOP their cunning and devious ways of obtaining money from poor and innocent motorists!

As for driving one way, only people that suffers from the daily holdups in lagos, will understand why she took one way! Spending 3hours in one spot everyday is no joke! Then you will understand the desperation! This is why i LAUGH at fashola's stupid laws! Has he never driven one way in Lagos in his entire life? Because he can blow siren and get to anywhere he is going fast, he has forgotten what the average poor nigerian man faces daily in the horrible traffic!

Other states don't have this kind of problem, only LAGOS! If he wants only 250,000 people in Lagos, was it his father and mother that developed lagos all by itself?

  98. If she's truly innocent, good for her but she should still be prosecuted for her lawless act.
I can't but help notice all the praise and thanksgiving to God in people's comments. I believe we can thank God as well for givin her the brains to drive against traffic and disobey governmental laws. I am sure there will be a thanksgiving service at her church next Sunday and the pastor/priest will not educate her about disobeying the laws set by authority and how GOD frowns at it.
I wonder at times if we are all serving the same GOD. GOD does not vindicate lawless and irresponsible people.
I'm sure this Nigerian God will vindicate an armed robber wrongly accused of assasination too.

  99. So in effect, what some ppl r saying here is that Yinka started the set of circumstances that led to this mans death?
By driving on the wrong side of traffic and,not stopping when asked to.
The victim seem to have been forgotten in our commentary but who ever killed this man or caused his death has blood on their hands and it comes with consequences!

  100. Joke says:
Nigerians, pls try to follow the driving rules and regulations, stop trying to cut corners. Following rules is practiced in other countries, pls let us be obedient. I know sometimes the short cut will get u there faster, but think of other people. Am sure most of this accidents in Nigeria happens because of someone not following the rules pls try to be obedient.

Ok Ok Ok... to all my lawyers in the house calm down jare, My best bet is Yinka won't be suing anybody anytime soon, because she probably cut a deal with them; false imprisonment and all the wuruwuru they did the first couple of days in exchange for a lesser charge. Also if we want to get technical here I would accuse her of Reckless endangerment and Not Manslaughter, she wasn't in anyway the direct cause of the accident that took the Lastma dudes life. Please who sent lastma to use leg and be chasing car? Is it part of their Job description? When he was done pulling her over what was he still doing in the middle of the road??
Also I agree with all of you stating the fact that she has money and it helped her!! oh I would say that is a good thing, I would rather have money, hire good lawyers and put pressure on the police any way I can, as long as I get my freedom if wrongly accused....my people this case should even inspire us all the more to be successful (and Favored by God, cos all the money in this world won't get some people out of similar quantas)...shikenaa

  110. Are you guys kidding me, the lady was wrongly accused for a crime she didn't commit.I wanto believe u all supporting LASTMA are LASTMA staffs, so I don't blame, that lady is even supposed to sue those people for wrong accusation. Bcuz they have ruined her reputation. If she voilated traffic rules, she didn't send the LASTMA guy to stand and get hit by a danfo driver, my cuz was an eyewithness of that scene.and all ye LASTMA people, stop looking for who to put blame on, get proper training and stop being lousy on the road. In other words, RIP the LASTMA guy.

  111. i was at my favourite buka yesterday doing justice to the plate of amala and abula soup when i heard a twist to the whole story ooo

earlier in the morning of the the accident, the deceased lastma officer wrongfully arrested an alhaji and the old man placed a curse on the lastma officer that if he(the old man) is being punished unjustly the lastma fellow will not live to see the sun rise again.

don't ask me question oooo, na my amala i dey eat jeje ooo

  112. Thank God for those that came forward with the truth! It's very sad to think that she was falsely imprisoned and if there were no eye witnesses, she would have remained there! Extremely terrible! Thank God she made it out! Thank God!

  116. May the soul of the departed rest in peace, May Allah grant him Al-jana fidau......

God knows the truth and i believe both Yinka and the dead knows the truth.

Who are we to judge, lets leave the judgement to the ultimate unbiased Judge.......

But one thing is certain, we all will rewarded accordingly.

    ReplyDelete
  117. @ thank God you re not at judge cos ur sense of judgement is very clouded.
Incase you didnt read the write up well, she is not going scot free, she has already been charged with reckless driving offence which is actually the crime she committed.you cannot manufacture a bogus offence nd tie it to her neck jus becos someone was stupid enuf to stand in front of a moving vehicle.Lagos state should do the right thing if it wants to stop traffic violation, install cctv camera on our roads so that traffic offenders can be caught witout endangering anyone's life.As for lastma officials,i ve this to say, stop jumping in front of moving vechicles jus becos you want to catch traffic offenders,ur life has no duplicate.

who should be charged for man slaughter? the lady driving or the official who put himself in harms way

  119. Now I am convinced that Nigerians are extremely wicked and heartless people. To shownoja and his supporters, this is why people like you are always poor in spirit and wealth. Your hatred for others and the way you wish evil on others will never allow the mercy of God to flow on you. You people are a hateful and spiteful bunch and you should really read the bible more. God will never visit you with His mercy with this blackness in your heart. You are trying to pin manslaughter charges on an innocent woman.

Let me ask you this, if you are crossing the road and with someone else and your companion stops in the middle of the road to tie his shoes and a car hits him, are you guilty? By your assertions you are. As much as this example does not make sense is the same way you guys don't make sense. You are just a bunch of evil people that will never see the grace of God in your lives

  120. Linda i did not want to comment on this sad issue but i cant hold it any more am laffing my heada off. so they finally let her go the question i am asking is who killed the lastma guy since no be madam banker who kill the lastma guy. Madam banker got off easily becos she is well connected and she has got moni daat is the truth pure and simple with out moni u are no body in Nigeria.if only we had a CCTV camera in major high way the truth would have be known well this is another sad unsolved murder

  122. this blog is definitely annoying because retards just come and write rubbish and u feel you should give them a dirty slap out of anger...too many senseless comments

    ReplyDelete
  123. Shownoja as much as you may be speaking from the legal angle have you taken into consideration that the LASTMA official could have put himself in harms way...They have a responsibility to protect themselves, if you have ever witnessed a LASTMA official on duty you would notice that there is no difference between them and touts they practically chase, drag and even fight, during such processes they even forget they are on the road. There are cases of them getting knocked down, its not the first, they should be properly trained, some don't even know the road laws, a moving vehicle cannot just come to a halt by jumping in front of them.

Thank God for the witnesses & those who came out to appeal, who knows what would have happened if there was no witness.

  127. I'm happy her murder charge was dropped. However, let her be the first culprit of the Lagos State traffic law for reckless driving. Isn't that 3years jail, 20k + psychiatric?

    ReplyDelete
  128. They should charge the LASTMA pple for filing false report. Rubbish

    ReplyDelete
  129. You did well, Linda :-)

My comment is based on the fact that I rarely read other sources of news from Nigeria. I'm assuming you're the only one to carry this story. Even if you're not, I'm sure the greatest public outcry from a social networking site came from your blog.
