Late Alex Ibru's wife and brother drag themselves to court over his property

The brother, Goodie Ibru and wife, Maiden Ibru, of the late Guardian publisher who died in November 2011, have dragged themselves to the federal high court, Lagos, fighting over the shut down or otherwise of a company belonging to the late publisher and his brother.

The fragility of the harmony in the family of the late Publisher of The Guardian, Mr. Alex Uruemu Ibru, was on Wednesday unmasked at the Federal High Court, Lagos where the late businessman’s wife, Maiden, and his brother, Goodie, are warring over the winding-up or otherwise of a company.

Justice Okechukwu Okeke was on the cusp of making his pronouncement on the submissions of both lawyers at the petition filed by Dr. Tunji Braithwaite, Maiden’s lawyer, against Tourist Company of Nigeria Plc, jointly owned by her late husband and his brothers. But Mrs. Ibru suddenly stuck her hand up, asking for “two minutes” to speak on her reasons for filing the suit.

“Six months before my husband died, the doctors told me that he was going to die,” she began. “And for five months, he was out of circulation and nobody saw him. Even his family members did not bother about him.”

As she explained, the late Alex Ibru was so dissatisfied with his kinsmen that he embarked on a hunger strike two weeks before his eventual death. When the family members learnt of it, some of them, including Goodie, visited him.

“Then my husband said he was going to fight him to the finish, dead or alive. That even when he dies, he would continue the fight unless Goodie resigned as chairman of the company — Tourist Company Nigeria Plc,” she continued. “He said that of all his brothers, the last person that he thought would betray him was Goodie. They had altered some of the company’s documents, diverted money and committed all sort of atrocities without the knowledge of my husband. I am a widow and I have children to take care of.”

In a revelation that shocked those present at the court, Maiden said that as she was about to enter the court, she saw her husband, who encouraged her to proceed with her actions, because he was himself unhappy with Goodie.

Suing on behalf of Omamo Investments Corporation, owned by her late husband, Maiden is seeking to close down Tourist Company, which owns the Federal Palace Hotel and Casino located in Victoria Island, Lagos, on allegations of indebtedness.

“Omamo Investments, between 2003 and 2009, lent to the Tourist Company $7.1m, N610m, N381m and N19m, which the company has been unable to repay,” she wrote in her petition. She prayed the court to wind up the company for insolvency, adding that she had made several futile demands on the respondent.

“The respondent has failed beyond resuscitation, has insufficient assets to meet its liabilities, does not have the capacity to meet the conditions for which it was incorporated, and has suffered a total erosion of its capital base,” she argued. “The respondent is both cash-flow and balance-sheet insolvent, and has not been carrying on effectively, the business of hotelling and catering.”
 
She then urged the court to wind up the Company under the provisions of the Companies and Allied Matters Act, CAP C20 LFN 2004, and appoint the President of the Chartered Accountants of Nigeria (ICAN) or any nominee of his as provisional liquidator.

But denying Maiden’s claims, the respondent asked the court to dismiss the suit for its incompetence, as it states no reasonable cause of action and represents gross abuse of court process.

The company’s lawyer, Onyebuchi Aniakor, argued that no grounds, as provided for by law, had been disclosed by the petitioner to justify the commencement of a winding-up proceeding.

“The petitioner has not shown that the alleged indebtedness, the subject matter of the petition, was due for payment or payable by the respondent,” he observed. He also reasoned no demand for payment on the alleged indebtedness had been made, contrary to the petitioner’s claim.

There is however a slender chance of an out-of-court settlement, following the presentation of a letter to the court, written by Chief Edwin Clark and J.P Clark — two Delta statesmen who sought indefinite adjournment of the case for the exploration of the option of peaceful settlement.

“As members of the family, the two parties are our relations,” a portion of the letter read. We will like the court to give us the opportunity to intervene and settle the matter amicably.”

But Braithwaite urged the court to overlook the letter because the writers were insignificant to the case and were not party to the petition.

Aniakor seemed slightly disposed to amicable resolution, though, saying that the writers had good intentions. But he left the final decision to the court, saying it was its duty to decide the best way to resolve the case before it.

In his decision, Justice Okeke adjourned the case for one week with the hope that the parties would have amicably resolved the dispute out of court, in view of the provision of Section 17 of the court rules.

He also announced his intention to withdraw from handling the case forthwith and return its file to the Chief Judge for reassignment to another judge, citing the petitioner’s letter to the Chief Judge demanding the transfer.

Before Maiden’s bombshell lawsuit, the Ibru family had over the years managed to keep the cracks in the large family under wraps and away from the mainstream media until Michael’s wife, Cecilia, a former Group Managing Director of Oceanic Bank Plc embarrassed the family about two years ago when the pleaded guilty to several criminal indictments relating to bank fraud and extensive money laundering. She served her sentence at the Ikoyi Prisons.

It is however unclear how the Ibru family led by Olorogun Michael Ibru will resolve this dispute as Michael, who helped educate his brothers and assisted them create their own businesses, is presently not in the best state of health himself. Whether his other surviving brother, Felix, a former Governor of Delta State and ex senator can save the family from further embarrassments remains doubtful.

  3. Alex and Goodie always seemed the closest and the best of the lot. I think there's also Bernard (he's quiet.) There are sisters too, so they should all come together and settle this. It's sad that death causes all sorts of issues for families.

  9. This tread is just too common in our Nigerian setting. Families bully their way into collecting everything from the widow using 'we are your in-laws authority' Wont the woman eat and look after her kids? Families should let go. Sister in laws are the worst. Men, tidy up your acts. Once you are married with children, those are your number 1 priority. Your family can get the change. This woman really suffered a lot looking after this man. He was shot by Abachas squad, he had a stroke and Parkinsons diesease. Guess he saw this coming, thats why he handed over the Guardian Newspaper to his wife before he died. They tried that crap with Cecilia, claiming Oceanic Bank belonged to all the brothers. In all fairness to her she set it up herself using her husbands money (Baba Michaels) Anyway the old man has settled all his children, so their would be no case of any brother shouting. Its sad though.

A similar scenario played out when my dad died!All his so-called brothers were nowhere to be found when he was sick for 3 months prior to his death.Trust them to show their ugly faces after he died!Trying to lay claim to what is not their own!Stupid pple with very crude thinking!Madam Maiden,pls fight for what is truly yours!Its you and your children's right!

  15. @Roli, your dumbness and stupidity is mind boggling.You have no clue whether Maiden is trying to cheat Goodie or not, you start spewing rubbish. I do not support neither of them. If either of them truly loved Alex Ibru they would accept defeat for the sake of his memory.No amount of worldly possession is worth all this.
    Painting Goodie Ibru black to make Maiden look like a saint is the most idiotic thing any sane person can do.
    Both of them should withdraw the case from court and hide their heads in shame.
    I hope Michael Ibru has shared out his own now that he is alive? His brothers and Cecilia do not cross the same paths and neither is she a favourite of his other kids.

  22. These are the PRIVATE matters of a family (Mr Alex Ibru's immediate family)who have not made themselves out to be celebrities. Linda, you ought not make public matters to which you are not privy, particularly as concerns individuals who are not "public". You are a news blogger and quite frankly, this is not news. It is akin to you publishing a private divorce case. Please think about the unnecessary exposure you have given to a widow and her children simply to boost your profile.

    If you had any respect for privacy of those who have not presented themselves as "public personalities", then you should remove this post as it is of no concern to your readers or the world in general. They have a newspaper. If they wanted this matter to be made public, I am sure they would publish it themselves!

    I write this as someone who is VERY close to this family and VERY UPSET to find this as a "blog topic".

When u ® in court, ur 'private matters' become public record! †ђξ testimonies and documents are there for any one to access..î†'s like being arrested and charged by †ђξ police,†ђξ charge sheet is public record....     The Ibrus should have thought about that when they went to court.
    What were they thinking?That it would be a secret?
    The same reason i have no respect for the Williams (FRA), no amount of money is worth such public disgrace. Mrs Ibru should find other ways of sorting this out. Her husband's memory is being debased by this.
    Mr. Ibru should remember that no one goes to the grave with cash and that stealing from the sick and dead is a crime that even the devil himself will not sanction.
    No one will come out of this looking good. Both parties are tarnished.

Linda dnt mind dat person telling you not to publish it am a friend of Maiden's son and I think its right to publish it,cos the case is in court there's nothing wrong with it being in court its jst 2people not being able to agree,people are funny and I hope she wins cos she deserves to win,her husband was ill and were where are siblings no where to be found,she's fighting a course she believes in and May God help her,being a widow isn't easy and I pray peope r sympathetic towards her course,she not trying to enrich herself but figth for wat she believes in,God bless her,God bless her family,God bless my beautiful Linda and God bless all of us who reads this blog and comment as well. *Muah!*
