Italian judge sparks outrage after he clears accused rapist because his victim did not scream

A 46yr old sexual predator accused of raping a woman on a hospital bed walked free from justice as a judge acquitted him because his victim did not  did not call out for help. Although she said 'enough!' to the former colleague accused of raping her, the court ruled that this constituted too weak a reaction to prove that she was sexually attacked. Judge Diamante Minucci said:

'There was no crying, no screaming. You didn't push him away. We have to ask why?'
The alleged victim's lawyers argued that her silence represented her 'painful situation' rather than proof she had not been attacked.

The court ruling has sparked anger in Italy and justice minister Andrea Orlando has ordered an investigation. MP Annagrazia Calabria decried the ruling, saying:
'Certainly, you cannot punish the personal reaction of a woman terrified by what is happening to her.'
For his part, the defendant does not deny contact with the woman but insists their association was consensual.

  1. Hmm! These kind of cases are always very dicey. Video evidence would have done a lot more to prove it was a rape case. I remember a case someone told me last week. A Nigerian guy somewhere in Europe took home a white lady and they had sex twice, and she left and came back to arrest him the next day. She said she agreed to the first time they had sex, but she didn't agree to the second time (even though she didn't fight him off), which means the guy raped her. #TrueStory.

    1. Nice point. Running a blog does not make Linda a journalist. What i question most times is her Degree in English Language.

    1. People react in different ways when faced with danger. In the same vein, rape victims react in different ways. Some flee, some resist and some freeze. It's not their fault how they react.

  5. I think I see sense in this! Why can't she scream? When she is not dumb!

  7. Well, technically he's right. Not that it couldn't have been rape but that there wasn't enough to prove it cause the guy said it was consensual and with no surveillance to prove it wasn't(I'm assuming) . Not that he's innocent tho.. he probably is guilty. But there is no proof. You shouldn't let sentiment send a Man to jail when there is reasonable doubt.
