CCT Defiance of Subsisting Court Order: Our Stand

Press release from the office of the Senate Office
Following the development in the Code of Conduct Tribunal (CCT) today, Friday, September 18, 2015 when the Tribunal chose to ignore the subsisting order of a Federal High Court by sitting, we hereby state our position as follows:
1. While the Senate President, Dr. Abubakar Bukola Saraki, had stated and maintains that he is ready to submit himself to due process of the law on any issue concerning him, he also believes he has an inalienable right to resort to the same judiciary for protection when he feels his fundamental rights are about to be infringed upon.

2. It is for this reason that Dr. Saraki, having satisfied himself that the case filed by the CCB and the manner in which the case was filed show that he will not be given justice, resorted to the Federal High Court for the determination of the issues of competence of the prosecutor as well as compliance with the procedure stipulated in the Code of Conduct Bureau and Tribunal Act.

3. The Federal High Court on Thursday, September 17, 2015, therefore ordered that the all parties in the case should appear before it on Monday, September 21,  2015. The implication of this ruling by a Court of competent jurisdiction is that the sitting today has been overtaken by event. It is for this reason that Dr. Saraki chose to go about with his normal official schedule.


4. Today at the Tribunal, Counsel to the Senate President, Mr. M. A. Mahmud (SAN), raised a motion stating that there is a pending constitutional matter before the Federal High Court to be decided on Monday and that the Tribunal should hold the trial until the constitutional matter is disposed of.

5. We are however dismayed that the Tribunal chose to disregard the order of the Federal High Court and the motion to suspend hearing till Monday when all parties are expected to argue their positions on the constitutional matter.

6. It is also a surprise to us that despite the application by the lead counsel to the Senate President that he will produce Dr. Saraki on Monday and the personality of the person  involved as the Number three man in the country, the Tribunal insisted on issuing a warrant of arrest as if its intention is simply to embarrass Dr. Saraki. We are not unmindful of the fact that the Tribunal is acting under political influence and external pressure. This is dangerous to our democracy.

7. The conduct of the Tribunal  today left nobody in doubt that it cannot do justice on the matter before it. It is also clear that today's decision is an abuse of the rule of law which portends danger to our judicial system. The Tribunal has equally set a bad precedent in the way and manner it conducted itself during the proceedings.

8. We want to emphasise the fact that this is not part of any war against corruption but using state institutions to fight political opponents and seeking to achieve  through the back door what some people cannot get through democratic process.

9. We need to caution here that in a desperate bid to settle political scores and nail imaginary enemies, we should not destroy our democratic institutions and heat the polity for selfish reasons. Let us all learn from history.


9. The Senate President is a law abiding citizen who will not do anything to undermine the judicial process and authority. However, Dr. Saraki will always act to protect his fundamental human rights.

    2. There is no buhari chapter and tinubu chapter. Pls stop deceiving urself. Tinubu & buhari are on d same side. D division in d apc is between d old members (d opposition political parties who formed APC) & d pdp ship jumpers, headed by atiku.

      The pdp members are power hungry (which was d reason they left pdp in d first place) & d founding members dont want to give in at all. The founding members believe their strength is in a centralized party positioning differentiated from the pdp since they themselves are from different backgrounds. This is d way their party has bn working & winning governorship elections.

      The problem is d new pdp recruits have their own independent clout. And d founding members believe if they give in to one rebel, d new members will wrestle power out of their hands.
      You cant reap where u didnt sow. Chop & clean mouth somewhere, then come here and throw all d toys out of d cot bcos u feel ur too big to go through their established processes. The new members met pple in d APC & they met their way of doing things. Its not okay. You work as a team, and win pple to ur side by negotiation & schmoozing. You dont come in newly, hold a gun to their heads & tell them its ur way or d highway. Dts not a team player, dts a greedy usurper.

Out of curiosity, I would like my learned friends out there to enlighten me if the constitution in Nigeria allows usurpation of Judicial power by the Judiciary? Bringing up injunction to slow up a judicial process that is trying to ascertain if you were truthful with your declaration. claiming the reason for it, is due to external political pressure is just absurd. i mean you are the senate president(president of the institution of law makers) .You should know better. Rallying any kind of support from the Nigerian public is just a waste of time because we can't sympathize with you, we have real problems like paying our bills. claiming you might not get justice is absolutely shameful.   71. There are two issues here: The matter at the CCT and the claim that the right of the Senate President is about to be violated. Following the trend and the debacle that threw up Saraki as Senate President and the brouhaha that followed; one cannot help but advise that caution should be employed in this war against corruption. Moreover when the order of a competent court is subsisting.

    We must start with respecting our courts; that is the rule of Law and the foundation for a sane society. The order of the court is an interim order and not perpetual. I think the first thing should have been for everybody including CCT to obey and sort that out first.

  73. @ATHANATIUS AYOBA MBADUGHA, i so much love you comment. If we must have a sane society and have a corruption free community, the rule of law must be obeyed.

    I personally love the prosecution of corrupt leaders and elite in our society but all must follow due process. If we all can exercise objective view, ordering the arrest of Saraki is totally uncalled for all bcos someone somewhere wants to get back @him. If truly Buhari, meant well for this country he must follow due process and not garagara style.

    It is very obvious the people that constitute CCT can never be objective with the way they started.

    God help this country.

Inordinate ambition of Tinubu and his blind supporters in APC will plunge this country into another political crisis. 4 months after APC took over rather than get down to business of governance, they are still busy strategising on pulling down Saraki. The country is gradually going down, yet no clear economic blue print. When you disagree they say you are a PDP loser, but it is clear APC has not managed their victory. This war of attrition is doing no one any good. Where was the so called Code of Conduct Bureau for the past years??? SHAME to APC

    issuing of an arrest warrant irrespective of strong commitment from saraki's counsel to produce the senate president only suggest the motive to rubbish the senate president by the powers that be..

    the CCT judge must be changed to avoid bias.
