Appeal court declares Sen. Dino Melaye's election tribunal should be re-tried

The Court of Appeal in Abuja on Friday set aside the decision of the National Assembly Election Petition Tribunal in Kogi which struck out the petition of Sen. Smart Adeyemi. Adeyemi of Peoples Democratic Party (PDP) had challenged the election of Sen. Dino Melaye of APC, alleging electoral irregularities and malpractices.


Justice Muhammed Adume held that the tribunal was wrong in striking out Adeyemi’s petition on the grounds of technicalities, instead of substantial justice. The appellate court, therefore, remitted the case to the tribunal for “trial on merit’’.

The court further held that the decision of the tribunal that Adeyemi did not file his petition within the time frame allowed by law was wrong and nullified it forthwith. Adume said the respondents did not provide sufficient evidence before the tribunal that the petition was filed late.

The News Agency of Nigeria (NAN) recalls that the tribunal had dismissed the petition of Adeyemi, a one-time National President, Nigeria Union of Journalists (NUJ) for late filing. The tribunal Chairman, Justice Akon Ikpeme, had in the ruling of June 18, held that the Kogi West ex-Senator’s case was “incurably defective’’.

  29. It should come as a standing rule that No Elected Member of the NASS should be sworn in or be given an committee leadership if they have a petition or a case in Court about their election. Let the National Assembly be truly honourable and scandal free. What happens if criminals get prematurely sworn in and they end up embarrassing the country and their constituency. Imagine that a thief steals the ballot, collects all the initial entitlements and allowances, how do you retrieve those undeserved benefits after his election is nullified by s tribunal? In the case of Dino Melaye, we are already seeing him giving a bad image to the Senate as a bootlicker, houseboy and supporter of corruption. Imagine that he rigged his election, gets a committee post, runs around EFCC with other thieves and legislates against jailing of thieves like him, would that reflect well on the credibility of other Senators? Dino should stand down his recent Publicity Committee appointment until his election tribunal validates him as qualified to be in the Senate. And until cleared, he has no moral right to vote on any debate.
