Comedian Julius Agwu sues Etisalat for N100m over blocked line

Comedian Julius Agwu has dragged telecoms giant Etisalat to court for blocking his business line. He is demanding for N100million as compensation for jobs lost, contact lost, for the inconveniences, and for being mistreated by Etisalat staff. Below is a statement from his lawyer, Festus Keyamo...
We are solicitors to Mr. Julius Agwu, one of Nigeria's most sought after entertainers (hereinafter referred to as "our client") and on whose behalf we write.
Our client is the owner of the Etisalat GSM phone number 08189555555, which he uses as his business line. On the 8th of October, 2013, our client travelled out of the country and returned on the 17th of the same month. Upon his return, he tried severally to make calls from the aforestated GSM line but same could not connect. Not only could he not make calls, he also could not receive calls on the said GSM line. This continued for some days until he got a message that his line had been blocked by the network provider.

Sequel to the above message, our client promptly visited your Abuja office at Hilton to report the matter. He was attended to by one Miss Joan, who informed him that somebody swapped his line. After our client successfully answered the security questions put to him, he was informed that his line had been restored, but the credit balance on the line was not returned.

Surprisingly, our client's aforestated line was blocked again after he left your said Abuja office. Once again our client visited your office at the local wing of the Murtala Mohammed International Airport Ikeja, Lagos to lodge a complaint, but painfully, nothing was done about it.

However, after sometime, our client was invited for a meeting at your head office in Lagos on the 14th of November, 2013 which he duly honoured. Present at the meeting (in addition to the officials of your organization) was Mr. Mobolaji Okusaga, the Managing Director of The Quadrant Company, in his capacity as media agents/managers for Etisalat Nigeria.

At the end of the meeting, our client was told for the umpteenth time that they would get back to him, which they again failed to do.

LOSS OF BUSINESS OPPORTUNITIES

It cannot be over emphasized that your actions of unlawfully blocking and/or swapping our client's line occasioned loss of business opportunities to him. As you are aware, our client as one of the most sought after Nigerian entertainers needs his phone line to be easily accessible to keep his business going. It therefore goes without saying that our client has lost some business opportunities as a result of your actions.

TAKE NOTICE that we have our client's firm instruction to demand and hereby demand the sum of N100,000,000.00 (One Hundred Million Naira) as compensation for the loss of business opportunities and the inconvenience caused our client by reason of your unlawful and unjustified blocking and/or swapping of our client's Etisalat GSM phone line.

TAKE FURTHER NOTICE that in the event that you fail, refuse or neglect to accede to our above stated demand within seven (7) days from the receipt of this letter, we shall be compelled to set in motion against you, all legal machineries necessary to obtain legal remedy for our client.

      1.. Didn't you hear him say it was a business line used for strictly Julius Agwu the brand business matters and not personal .. His PA is a works and represents the Brand and as such can register the line on behalf of Brand Julius.

      2. In your careless fishwife manner you said " the line was not even registered by Julius". Joan are you saying that network tossed the line because the thought it belonged to an ordinary Nigerian and that Etisalat renders service based on who is who.

      3 . Have you ever worked in the Finance dept of the Julius Agwu brand so much that you know how much business he can possibly execute in a" few" days as you put it.

      4. Do you realise that you have further thrown the organization that feeds you in badlight by coming discuss confidential info your customer entrusted in your care on a public blog.

      Joan I can assure you Etisalat and Julius Agwu will settle this matter like gentlemen and our Job will be sacrificed as that is done .. Mark my word ..

    It is really painful when you go through such issues...a lot of people may criticize Julius Agwu for his actions, but I want y'll to put yourselves in his shoes.
    I suffered same with MTN, and it wasn't easy at all. I literally just had to back out after several attempts and am glad for Julius Agwu's actions, as this will serve as a lesson to all of them!

  17. This is exactly what these telecommunication companies need. They need someone to drag their lame ass, sorry good for nothing networks and bad customer representatives to court. Its rather sad that this has happened but what's worse is that J.A. is not the only one that got this treatment and unfortunately the regular 9-5 worker cannot afford to drag such companies to court as they cannot afford the risk If their case is thrown out of court or the opposition wins. How many regular citizens can be invited in for a chat talk less of being compensated???
    If this was a human error of the wrong telephone number being swapped/disconnected, then I truly feel sorry for that member of staff.
    How I wish this was an MTN case.....mschewww!!!

We Nigerians really need to stop allowing sentiments over cloud our sense of fair judgement...Julius is right to sue Etisalat for unlawfully blocking his line and not doing anything about it when he apprehended them, it could be really frustrating @ times wat dis service providers can make u go through just to secure ur line...let him teach them a lesson so that others can learn. We r customers paying for the services they render and we need to be treated as such!

The lawsuit should have been 5billion naira and make it a class action suit and pay it back by crediting every Etisalat customer with 1000 credit. These nonsense by these companies should be curbed someway somehow.

  92. Etisalat is even trying.. An Mtn customer care rep and I once insulted ourselves over the phone after I had called them for over a period of 2 weeks to resolve an issue with no result... I then went to their customer care center at college road and told them that I would use my etisalat line and stop using the mtn line till they resolved the issue.. The customer care rep actually told me to go ahead and use etisalat.

  103. @ Ayo Bullshit. That this happens to Nigerians all the time does not make it okay. Nigerians allow themselves to be trampled by these companies and at our expense. We pay them for services and we do not get service in return. To add pepper to fire, they even run you around. Let him sue. There are two things here - Etisalat would at least have to spend money to answer him. Now that is unplanned cost. The only reason that people are in check in the US is because of law suits. People behave appropriately cos you don't wanna have to pay an attorney by the hour to squash a claim on your org, no matter how small the claim. First, you want to protect your company from the "a flood gates effect". That is if there is one successful argument against you, you just became the sole source of income for some people. Second, any previous judgment against you is forever held against you in the public court of opinion. Often hard to shake when you are dealing with a jury or people not on your payroll. So let Julius sue. Adenuga is riding high on MTN. But nobody can make a reliable 5 min call from the US to a Nigerian MTN phone successfully without several drops due to poor audio quality and interference. This is sad considering that people actually paid for the service.

  108. In the network of the blind(MTN, ETISALAT, GLO, VISAFONE, AIRTEL) the one-eyed Network (Etisalat) is the king.
    Since August 2013, an Etisalat customer care lady promised to return my internet subscription within 24hrs and up till dis night that I can't sleep because I just put off my Gen she has not.
    I would rather use etisalat in Dubai than Nigeria. what makes their network there better than ours or is it not the same network?
    Nigerians please if someone stands up for his right let's support him and hope the networks can listen and provide better services for our businesses to blossom....beesteeze.

Every adult in Nigeria knows that if your sim isnt registered, you are given some grace period to do so, and if that grace period elapses, your sim is blocked so you are forced to get it registered. Julius didnt register his line, and so, doesnt have a case. Lets always get our facts right before jumping to conclusions and crying foul! Etisalat is the best network in Nigeria. No bias!

    Firstly the way companies have been dashing out money in Nigeria in the name of brand ambassdors is getting riducolusly toooo much. They dont even practice CSR(which NIG doesnt encourage)Hence Julius asking for 100m...lol

    Secondly, is it not Nigeria??? where everybody has 2phones & U most times dont have credit/battery so U call on the other fone or we all know each other especially in the media/enterainment industry.So if Julius phone was blocked, is he saying nobody could reach him through other means apart from his said Etisalat sim?

    Thirdly, what is the possiblity that he missed or has missed calls during the blocked period?

    Fourthly, customer service is ZERO in Nigeria. PPle on that desk are never cool to people who are just making enquires. They only smile to those that give them gifts or are frequent faces.

    Abeg both Etisalat & Juilus/Festus should go & siddon and cover their heads for stupidity on various factors. Etisalat and other coys in Nigeria should wake up from sleep and do the right things.
    Julius do you know how people that have had the same issue but cant afford a lawyer? instead you want 100m.. bros cool down jare... 100m go finish in 1year(fuel, gas, diesel, school fees, booze, clothes, rent/maintainance etc).

    My point is not making these companies get away all the time or fellow Nigerians coming up with schemes to sue but lets be real..... WE ARE SLEEPING & NOT GETTING PRIOTIES RIGHT.

People are now so used to victimization and poor service, when they see other people demanding better, they immediately cry out: are you the only one. People have complained incessantly about poor services delivered by these networks over the years. But nobody ever had the guts to stand up to them. Now somebody has, you are saying it's because the man is a celebrity. I tire for Nigerians o. We only pay lip-service to change. Put your money where your mouth is. Julius - well done.
