Court refuses to stop impeachment move against Jonathan

A Federal High Court, Abuja, on Friday, refused to stop the House of Representatives from beginning impeachment moves against President Goodluck Jonathan over poor budget implementation.

Justice Gabriel Kolawole declined the exparte application by the National Chairman of African Liberation Party (ALP), Dr. Emmanuel Osita Okere, who asked the court to stop the House.



Emphasizing the need for caution, the court said it must have been established that the impeachment proceedings had begun before it could hear the suit in order not to interfere with the functions of the House.

By the provision of Section 143 (1) of the 1999 Constitution, the court held that no single arm of the national assembly can unilaterally impeach the president, adding that it requires a joint resolution of the House and the Senate before the president could be removed.

By not joining the Senate as a party to the suit, the court said, the motion ex-parte cannot succeed.

"This may not be the proper occasion for this court to grant ex parte order against the 2nd and 3rd defendants, as the reliefs sought by the plaintiff largely benefits the president", the court said.

Justice Kolawole accordingly refused the ex parte order and adjourned the matter indefinitely, for the Chief Judge to re-assign the case.

Moving the exparte application, the Applicant's counsel, Alex Williams had prayed the court to grant an interim order restraining the House, saying, it was capable of distracting the president from discharging his duties.

The defendants are the Speaker Aminu Tambuwal; the House of Representatives, the Attorney General of the Federation and Minister of Justice and President Jonathan.

In his affidavit in support of the originating summons, the plaintiff stated that the move to impeach the president is heating up the polity, describing it as a disguise to cause political turmoil.

    1. I agree with u, whatever they label him, he is still better than those who ruled the country for a better part of the 50yrs with nothing to show for it. After all, this is the freest democracy, at least people get to run their mouth withoit the fear of being killed or dumped into the sea. Abegi, leave Jonathan Jare, with all his inepttitude, we prefer him to Boko t mallams.

  19. Am from d South, so the people that say rubbish about leaving him alone should shut up already. He is a disgrace. However, all this one na wash wash. They are trying to make him look like a survivor, we've seen this all before. Then, the person that called Buhari's name should buy a Government textbook. Goodluck by playing the victim is just destroying this country. Buhari cannot be behind this, you vote in a party not person, so PDP will still takeover. Goodluck is the worst thing that has ever happened to us, by the time he is done putting us in debt, the next 20years, our children will think know his name...

  27. All those saying Goodluck is better or Buhari is better, what it the basis of your comparism? On what facts, figures or indices have you based your esteemed opinion?

    The propblem with us (Nigerians) is that we are all parrots! We mindlessly repeat whatever sentiment we have heard and we do it so often that it becomes our truth...never mind that the facts say different. We are intellectually lazy and so we do not bother to source for facts before we open our mouths and blab! It so sad and disgraceful!!

    Truth is that neither of them is better than the other. They all have their hands up to the shoulder blades in muck and mediocrity and when they throw us the scarps and crumbs from the buffet table we sing their praises to the high heavens!

    I once heard that a people get the leaders they deserve. This is surely the case with Nigerians cos until we are ready to take responsiblity and demand the highest standards from ourselves and others, until we are able to speak the truth without fear nor favour, until words such as integrity, diligence and honour begin to make sense to us, we will get no better than the kinds of leaders we've had for the last 40 years...and we will deserve no better!
